It's a great read - the majority opinion totally decimates the lame arguments of the San Francisco city attorney. It almost reads like they're spanking a little child - enjoy!

I thought SCOCA judges were elected. I am remembering the campaign to get rid of Rose Bird.

The California Supreme Court is already on the "bad list" of a growing number of pro-family Californians. In 1997, four justices (George, Chin, Kennard, Werdegar) overturned the states law requiring parental consent for abortion.
In 2003, four justices (George, Kennard, Moreno, Werdegar) wrote the majority opinion authorizing homosexual adoptions known as second-parent adoptions, although no such state law existed.

Calif judges are appointed and reaffirmed by ballot.
Fortunately, California voters have more power than voters in Massachusetts. We can and have recalled judges. In 1986, voters removed Rose Bird, the anti-death-penalty chief justice on the California Supreme Court, and two of her liberal associates.

No. If they appealed from this court it would have to be directly to the U.S. Supreme Court.
