Halifax man accused of making death threats against President George W. Bush

Fri Sep 10, 6:17 PM ET

HALIFAX (CP) - A man in Halifax has been charged with making death threats against U.S. President George W. Bush (news - web sites) over the Internet.

Timothy George Andrew, 28, has been remanded for a psychiatric assessment and is due back in court next week, the ATV news network reported Friday.

Threats allegedly found on an Internet message board included: "Death to the president of the U.S.A. and destruction to that nation's Babylon" as well as "The president of the U.S.A. is king of terror" and "The president of the U.S.A. is going to be killed and will never stand again."

RCMP said its investigation with the U.S. Secret Service started last October and ended late last month, resulting in charges of making threats and threatening Bush.

This whack job gets arrested and Kerry gets poo-pooed by the MSM (when he received a shotgun as a gift he thanked them and was sorry he couldn't take it to the debates with President Bush). Sounds like a bonified threat to me.

As dangerous as some of these nuts can be, I'm taking a perverted pleasure in watching liberals literally breakdown in front of my eyes. Savage was right; Liberalism is a mental disorder...and the longer Bush stays in office, the better chance we have of locking some of these poor souls up:)

Yes... it's time again for a...

Ping.

To get on or off this completely tasteless (yet, thankfully, irregular) ping list, just FReepmail me. I honour any and all requests as soon as I see them - and considering I have not much real life, that is often. Cheers, KaJac.

Canadian law may be different but under US law (18 USC 871), a person can be found guilty of threatening the President only if all of the following facts are proved beyond a reasonable doubt:

First: That the person uttered words alleged to be the threat against the President;

Second: That the person understood and meant the words he used as a true threat; and

Third: That the person uttered the words knowingly and willfully.

A "threat" is a statement expressing an intention to kill or injure the President; and a "true threat" means a serious threat as distinguished from words used as mere political argument, idle or careless talk, or something said in a joking manner.

It's unclear from the quotes provided in this article if the statements written by the accused on the internet message board expressed actual intent to kill the President. When does the right to free speech cross over from being offensive to being criminal?

Statements like "The president of the U.S.A. is king of terror" are clearly not threats but are just political opinions.

Statements like "The president of the U.S.A. is going to be killed and will never stand again" sound more like predictions but may be construed as threats.

"Death to the president of the U.S.A." is clearly an inflammatory statement but it doesn't really show intent as in "I am going to kill the president....".

When the head of the United Mine Workers presented Kerry with a Remington 11-87 shotgun during a Labor Day campaign stop in West Virginia, Kerry chortled, "I thank you for the gift, but I can't take it to the debate with me."

Now, that's a threat! He has motive, opportunity and an expressed intent to use a deadly firearm against the President. I think the Secret Service should investigate Kerry's threat.

Too bad the guy was busted. He had a promising career as a Kerry campaign advisor.

Doesn't surprise me.

Halifax has been slowly turning from Warden of Honour of the North to the City of Well Sort of Evil. It's becoming more and more distant from the rest of Nova Scotia.

It's not just because it's a big university city; it also seems to be drawing in more come-from-aways from Upper Canada and expatriate Americans attracted to our quaint little harbour city.

Naw. Prosecute John Kerry for illegally accepting a firearm without submitting the proper background check paperwork.

I am aware of the US Code (I checked it before making any statements regarding Kerry when he first made the threat).

Joseph Mazagwu, 35, a police officer who mouthed off while picking up his uniform at the cleaners has been indicted on a charge of threatening President Bush for allegedly saying he would shoot him and his father if someone gave him the bullets. (August 28, 2004).

This guy faces 5 years in prison for making statements without a weapon in his hands yet Kerry can do it, while holding a shotgun, and it is a joke? I'm not laughing and the Secret Service shouldn't be either.

God bless our troops wherever they may be.

Sgt. Preston left the Yukon tracking this guy to Halifax? Such dedication.

But according to Canadians on South Park, Canada has only one road ("Follow the only road, Follow ...)".
At least Sgt. Preston and King followed it in the right direction.

I have some of the radio series ("Challenge of the Yukon", WXYZ, Detroit). Once you get over the barking sound
effects, it's not bad for quick stories with a moral.
