CNN TAKES LEGAL ACTION AGAINST THE NATIONAL DEBATE OVER KERRY POLL PARODY (CNN Threatens blogger)
The National Debate ^ | 10/05/04 | Robert Cox

Posted on 10/06/2004 10:01:24 AM PDT by Dr. Zzyzx

I have been informed that CNN is now taking legal action against The National Debate over their objection to a faux news report on fake poll results showing John Kerry leading in a recent poll of fradulently registered voters. Can't these guys take a joke? I guess they can so long as it as the expense of George Bush. Poke a little fun at their candidate and they call out the lawyers. Good grief.

Over the past few days I have withheld publishing on the site as I consider my options. During that time CNN has been pushing my ISP to shut down my entire web site.

I have now filed a counterclaim so the page should be back up here soon.

DMCA COMPLAINT FROM CNN REGARDING THENATIONALDEBATE.COM

This is to notify you that the web site at http://www.thenationaldebate.com/other/CNNPoll.html and hosted by Zubrcom.net infringes upon the intellectual property rights of CNN.

We request that the site be immediately disabled and contact information for the site operator be forwarded to my attention at:

MY REPLY TO CNN

Kari,

Perhaps if you had simply contacted me with your concerns about my parody web page this matter could have been resolved quickly and amicably. Consider that for next time rather than a gratuitous (and bogus) invocation of the DMCA. Since I assume you are well aware that the web page in question is protected as parody under the First Amendment you have, I believe, perjured yourself in your DMCA claim.

I suggest you consider withdrawing your complaint before I file my own complaint with the Georgia Bar Association.

In the meantime, I have filed a counterclaim with my ISP and will defend my right to display the page as long as necessary.

Put this on your website:
Kerry leads in online polls voted on pushed by DNC.
In fact, Kerry and Edwards are so far ahead, they have 90% of the vote and will win the election.
Their online polls are a joke (as well as all the other online polls) because they are coordinated by the DNC to be repeated as "news" by the networks.
If you do that and need more info on it, private message me and I'll send them to you.

Robert Cox is spot on. CNN is dead wrong. Only a year ago, the US Supreme Court decided that parody is a protected form of speech under the First Amendment. The case was Acuff Music and it involved U-2's take-off on Orbison's "Pretty Woman."

CNN is being both a liar and a bully in this matter.

The problem is, that is probably an accurate assessment of the situation. That would make it very difficult to see any humor in it. Hope you win this one.

No they haven't lost their minds. They just have dropped the pretense that they are not fascists.

Maybe the thumbsuckers at CNN would like to sue Pat Caddell for calling them the "Clinton News Network" on numerous talk shows recently....

Maybe we should get the "Hoar of Babylon", Christianne Ammanpoor on the horn to guage the "arab world's reaction" to the vicious American satirical website...

or get a DNC talking head to erupt like Mt St Helens at the audacity of the right to actually make a joke during a time of war... a time of war that they opposed anyway...

and so on and so on...

Be Brave my Brother. CNN Sucks

But this is really rather foolish of them. Don't they know that our vast right-wing conspiracy can raise millions of dollars for legal fees overnight?

I saw John Kerry making his photo op phone call to Edwards. It's a theatre and nothing more. The entire Kerry campaign seems to be perception based instead of fact based.

This is only an early indicator that the dim-o-crats have no sense of humor. You shall have this view confirmed when the order goes out to "Deploy the Lawyers" at the time of the vote counting.
