KANSAS CITY, Mo. — The woman who allegedly strangled an expectant mother and cut the fetus out of her womb was arraigned on Monday before a packed courtroom.
Lisa Montgomery (search), of Melvern, Kan., was charged with kidnapping resulting in death in her first court appearance in Kansas City, Kan. She was later to be transferred to Missouri, where the charge was filed.
Wearing a navy-colored jumpsuit and slippers, Montgomery, 36, did not speak to the court as her public defender refused to waive her right to preliminary and identity hearings.
U.S. Magistrate Judge David Waxse scheduled both for 9 a.m. Thursday and declined a defense request for a gag order. Montgomery's public defender, Charles Dedmon, would not comment after the hearing.
Assistant U.S. Attorney Terra Morehead would not answer specific questions from reporters about the case, but authorities have said Montgomery confessed to the crime.
The suspect's husband, Kevin Montgomery, told reporters outside the courthouse he knew nothing about his wife's alleged actions. He has not been charged with any wrongdoing.
"My family has suffered a tragedy, but I am not the only family," he said. "This has to be as hard or harder on them as it is on me. I sure hope they get as much support from their church and community as I have because we are all going to need it."

Whether this was a theft or a kidnapping depends on whether a human was abducted or a mass of lifeless tissue was stolen. As in the Scott Peterson case, the pro-abortion will wisely not get in the middle, even though a ruling that this was a human being could again put the morality and legality of abortion before the courts.
Possibly because the jurisdiction recognizes the Felony Murder Rule: Any death directly and proximately caused during the commission of an enumerated felony (burglary, arson, armed robbery, rape, kidnapping) carries with it a Murder 1 charge.

It is such a SHAME that this thing cannot be forced to undergo the SAME kind of death she dealt out. Slice the B**ch open and let her slowly die.
That murdered mom was ALIVE when the baby was cut out of her. I CANNOT begin to IMAGINE the UTTER horror she endured in her last breaths of life.
But I CAN 'imagine' what she physically went through as her baby was cut out. 18 yrs ago, I had a C-section WITHOUT the benefit of anesthesia.
This happened in Cleveland a few years ago.
The woman was selling her SUV, and the murderer cut her open with the car keys and buried her in the garage (or something to that affect).
Fortunately, the animal killed herself when police showed up at her door, and child and father were reunited.
Who could even fathom something so sick.

Exactly. Forget about the fetus/baby argument for a moment and get a grip. A woman was murdered, brutally and mercilessly. It was a premeditated act and should have special circumstances added to the charge (if they have it there) because of its cruelty.
Can't you just hear the excuses coming, though? She was insane, suffering post-partum depression from the miscarriage, yadda yadda, liberal BS.
Having been a mediot for years, I think this is less a matter of politics, and more a matter of conforming to the AP Stylebook.
There are ABSOLUTELY NO EXCUSES for ANYONE who commits these kinds of grisly horrors.

She still could get the death penality in Missouri (1st degree homicide) if the Feds don't give her the Death penality.
I agree, how can anyone say a fetus was stolen out of a women's womb? Once it came out of the mother's womb it was no longer a fetus, it was a baby. However, I tend to believe it was a baby all along. I'm getting sick and tired of hearing people call this baby a fetus. This child is alive and went home with her family today. Still a fetus? I don't think so!
