Student Accuses School of Forcing Him to Dress as Female

Pittsylvania Co., VA - A Pittsylvania County school is being sued, accused of forcing a young boy to dress like a girl. The Twin Springs Elementary student claims school officials made him wear red fingernail polish, red lipstick and a hairbow, while attending classes.

The 5th grader says he was required to be referred to as "Mattie the new student." According to court documents, school officials deny all charges. We'll have much more on this story on the Night Team.

I can, Sue these BAS+rds, throw them out of the teaching peofession and take away their license to teach. They are the SCUM that have been perverting our children. I hope the Parents in this school district really get Pi$$ed get rid of these Scum!

Student sues school principal



MOUNT HERMON - A youngster who was a fifth-grader at Twin Springs Elementary School last year has filed a civil lawsuit in Pittsylvania County Circuit Court against the Twin Springs principal, assistant principal and county division superintendent.

As an 11-year-old on Jan. 23, 2004, the male student alleges he was "intentionally required to put on and wear red fingernail polish, red lipstick, and a hair bow in the school and attend classes.

Twin Springs principal Emma Austin, assistant principal Jenny Eaton and School Superintendent James E. McDaniel are named as defendants in the lawsuit which claims they "had a duty to protect the plaintiff from harm and injury while at school and a duty not to injure him."

Austin and Eaton are sued individually and in their official capacities as employees of the School Board. McDaniel is sued in his official capacity only.

The lawsuit alleges the administrators "should have known that their intentional and reckless conduct would likely cause emotional distress to the plaintiff" and characterizes their conduct as "outrageous, intolerable and negligent."

McDaniel is named because he is accused of not taking the proper disciplinary action against the administrators....

McDaniel is named because he is accused of not taking the proper disciplinary action against the administrators.

Judgment is sought by claiming the plaintiff was "caused to sustain injuries, endure embarrassment in the past and future and suffer pain of body and mind."

The lawsuit seeks judgment of $100,000 in compensatory damages, $100,000 in punitive damages, plus costs, expenses, attorney's fees and interest.

The lawsuit was filed on behalf of the minor by Ryan Thornberry, identified as his next friend.

The plaintiff's attorney is Glenn L. Berger of Berger and Thornhill of Altavista.

The defendants' attorney, Glenn W. Pulley of Clement & Wheatley in Danville, filed a "Grounds of Defense and Affirmative Defenses" Nov. 22, 2004.

They "deny that they are indebted to the plaintiff in any amount whatsoever," states court records.

The defendants deny requiring the fifth-grader to wear red nail polish, lipstick and a bow or be referred to as Mattie.

They deny requiring any conduct that would cause emotional distress.

"Wherefore, defendants Emma Austin, Jenny Eaton and James E. McDaniel deny that (the) plaintiff is entitled to any of the relief sought in the motion for judgment and move the court for entry of an order dismissing the motion for judgment with prejudice, together with an award of costs," states court records.

The defendants also filed a "Plea in Bar" Nov. 22, 2004, on grounds that the action brought by the plaintiff is barred by sovereign immunity.

The plea sights two Virginia Supreme Court cases which indicate governmental employees in Virginia are entitled to sovereign immunity in matters of simple negligence.

Also filed on Nov. 22, 2004, was a "demurrer" to the plantiff's motion for judgment contending that the lawsuit fails to state a claim upon which relief may be granted against them and the motion for judgment fails to fairly inform them of the nature and basis of the plaintiff's claims.

They have asked for dismissal.

An April hearing date has been set.

LOL! I have a really hard time buying this kid's story, but after reading and learning from things posted here, I would not be too surprised if it turns out to be true. We will have to wait and see. Perhaps the other students did this to him and the teachers ignored it, or he just made this up.

That's my first thought. Does this school have a "tolerance" program? How about transgender guest speakers and one-on-one counseling to "discover the true sexual orientation" of the students? Heck... in California they are busing students to Gay parades and showing videos (essentialy soft gay porn) without parental notification.

Many here might not realize how far this agenda has progressed across the country and infiltrated the school system. I don't know if there is any truth to this particular story. But I DO know enough about what is going on to not dismiss it immediately.

One more reason for good parents to sacrafice to be able to afford to put you child in private or home school. My ex-wife took my daughter out of private school because she claims she can't afford it. She averages 3 big vacations a year. This year they are planning to go to Hawaii and their HOUSE IS WORTH $300,000.SHE CAN'T AFFORD IT AND THIS IS AFTER I PAY $300 IN CHILD SUPPORT!!!....sorry for yelling I'm o.k. now.

More great journalism. The reporter obviously hasn't spoken with any of the parties involved in the case and took the little bit of information in the article from the court documents. It just leads to speculation and doesn't answer any questions at all.

I am skeptical. I can't even see them making a girl wear red fingernail polish, red lipstick and a hairbow. But it should not be too hard to get to the truth. If he really had to dress like this in classes, there will be quite a few witnesses

I suspect this is a tolerance program of some kind.

Last year many California schools forced kids to pretend to be Muslims for a week, read up on the Qran and Muslim prayers, and so on.

I can well imagine some nutjob telling the boys to come in on Tolerance Day in dresses, so they will understand that cross dressing is perfectly normal and that they shouldn't tease any of the LGBT students.

Whether the kid could have gotten out of this by taking the correct route, I don't know. But I really can't blame him or his parents for blowing their stacks. IF this is what happened.

There's an awful lot of this stuff around. I just happened to walk by the Harvey Milk school in NY the other day, and they have those stickers up saying this is an LGBT SAFE ZONE. And just a few days ago, I noticed that one of my colleagues at NYU has a sticker on her door saying that this is an LGBT SAFE ZONE, and that she had taken the course in sensitivity training which is required before you can put up that sticker. Bizarre. As if people were shooting down LGBT students in the street, and they could duck into these refuges to be safe.

- Neither can I, but it should be a relatively easy case to prove, one way or the other. There must have been dozens of witnesses to such an event.
The only situation where I can see this happening is if it were some kind of punishment for making fun of or teasing the boy's female classmates. If so, it was a poorly considered and completely inappropriate measure.

I find it hard to believe a lawyer would take the case without being a least 25% sure he could win the case. Probably taking in on a win basis. If they win they get paid otherwise they don't. Also, there should be lots of witnesses to this, friends, enemies, all the other kids.

That said I will take a wait and see attitude about this. Could be the kid is lying, could be he isn't.
