Formal Sentencing Delayed; Wrongful Death Suit Next

MODESTO -- Without the glare of media lights, a new legal battle involving the murder of pregnant choolteacher Laci Peterson and her unborn son unfolded in a Modesto courtroom Monday.

Lawyers met to set a date for the $5 million wrongful death suit filed by Laci's family against her husband and convicted killer, Scott. But there was one major stumbling block -- Scott Peterson's formal sentencing for the murders has been delayed from its scheduled Feb. 25th date......

-----------------------------------------------------------------------------------------------------------------------------------------

Rocha pressing civil lawsuit

Sharon Rocha is pressing forward with a wrongful death lawsuit against Scott Peterson to make sure her former son-in-law cannot profit from murdering his wife and unborn son, her attorney said Monday.

"We're after accountability," said attorney Adam Stewart of Modesto, who represents Rocha. "We're after preventing him from profiting in any way, shape or form."

But the civil lawsuit is on hold until a judge in Redwood City formally sentences Peterson, 32, who was convicted Nov. 12 of killing Laci Peterson and his unborn son Conner.

A jury recommended death; Peterson's attorneys hope to delay a formal sentencing set for Feb. 25.

Thanks, rb. Hope everyone is well. Looks like Geragos has years of delaying tactics left to propose.

Good morning, and thanks for the ping.

I don't understand why the sentencing will be delayed until March??

What's up with that?

What kind of a question is that? :)

Of course he'll be elected easily. This is the great state that has given us "Burp' Teddy, Barney Fag, and Jean Francois Cherry among other specimens.

[If Scott Peterson had drowned his wife in Mass. could he be elected Senator?]

No. You can only drown the woman who is a one-night fling and still be elected to the senate. Drowning your wife will make you a presidential cnadidate in Massachusetts.

I don't understand the purpose of the civil suit. Federal law already prohibits him from profiting from the murder. The jury recommended death, and even if the judge says no to the death penalty, he'll still probably get life without parole. So what can the family possibly gain from a civil suit? I'm not saying Peterson doesn't deserve this; I just don't think there is anything left to get. Can someone please explain this?

wrongful death suit to rip all funds the Peterson have to keep Scott from profiting from Laci Peterson's death. there is money to still be made off this crime. CBS is one aiming at it in the latest flick of the case.

I thought there was a federal law passed with Ted Bundy that prevented Peterson from profiting. If he sells his story to CBS, then Laci's family would get the money.

Mornin' rb.

When I read this in the hard copy Modesto Bee, I wondered if you would be posting it.

BTW, I'd like to report a theft. It appears someone has stolen the sun. How can I get a suntan with all this fog and low clouds? I'm prolly gonna rust. :)

Just think what Scott was willing to do to pay child support for the same amount of time. And the REAL price he will pay.

I think he better think it out again! lol
