DCF Considers Removing Schiavo from Hospice by Force
Palm Beach Post ^ | 3.23.05 | Dara Kam

Posted on 03/23/2005 2:34:59 PM PST by gopwinsin04

State officials say they are considering removing Terri Schiavo from hospice, by force if necessary, despite numerous court orders upholding the removal of the artificial nutrition tube that has kept her alive for 15 years.

Lucy Hadl, secretary of the Department of Children and Families, said Wednesday morning that her staff is relying on a state law that gives the department the authority to intervene on behalf of a vulnerable adult who is 'suffering from abuse or neglect that presents a risk of death or serious physical injury.'

Hadl said that the DCF would have to file a petition in order to remove Schiavo, but that 'it doesn't mean we'd have to have judicial approval in advance of taking the action if we believed it met the threshold for doing it.'

Hadl said that seven years of court rulings backing Schiavo's husband Michael, in his contention that Terri Schiavo did not wish to be kept alive artificially would not stop the DCF from taking action.

'We're not compelled to look at prior judicial proceedings,' Hadl said.

What we are compelled to look at is the presenting circumstances and any allegiations of abuse and neglect that we have recieved. So we have to deal with those and fufill out statutory responsibility.'

I think this would come down to the judge ordering the current LEO (County?) to not release....and the DCF using the state LEO.

It is being reported on another thread that Felos has also said he will bring assault and battery charges against anyone who tries to get Terri....

It's just an opinion. But a Governor has the power to do things a judge cannot. A Governor can call out the National Guard, he can declare curfew or martial law. Time will tell though Keith.

It is probably the local jurisdiction which is picking up the tab for the cops.

Since they work for the Exeuctive and do not follow orders then fire them.

The courts just have too much power right now. It is time for the other branches of the government to right the balance.

Liberals really want to see this innocent woman dead. Think about it, what would happen if Terri woke up? Liberals would be finished, they would be exposed for the evil anti-American murderers that they are. They must kill her as soon as possible to minimize the chance of her breaking out of her coma.

I understand where you're coming from.

But I wonder if Terri can wait much longer. She may be on her last breaths as we speak.

Just to give you an idea of how this is going to affect our country's foreign policy in the years to come. It ain't pretty.

The World's Superpower and Champion of Human Rights around the globe is starving and dehydrating a disabled woman to death and underage children who bring her water are being handcuffed and arrested.

Does that sum it up? Did I miss anything?

If Indonesia or Thailand want to have 6 year olds work in factories - that is their business - butt out - at least they don't starve and dehydrate their disabled citizens to death.

If China decides to put a bullet in the brain of all their retarded school children tomorrow, what can we say or do?

Next time we want to whine because Libya or Egypt is on the United Nations human rights council we better learn to bite our lip.

There is your perspective from over here. Im gonna try getting more on the local perspective today and try updating later in the day if I can.

He can bring the tortious form (which is a civil action) which would be useless unless there were actionable damages to pursue, but he does not have the authority to bring criminal assault and battery charges.

I condemn "brave" keyboard commandos that in the same position probably wouldn't exercise half the courage of Jeb Bush and the other Republicans.

That's generally my take. The cops are not part of the judicial branch, and are ultimately answerable to the Governor. In a test of wills, the cops would defer to the Governor.

Bush needs to issue an executive order saving this woman. Murdering and torturing an innocent woman is the most anti-American thing anyone could ever do. Bush needs to step up and protect Terri. Liberals would whine about it as usual, but they whine 24/7 anyway. Libs are powerless, just do the right thing Bush.
