Police officer charged with rape after offering woman ride home
BROCKTON - A police officer was charged with rape after he allegedly forced an intoxicated woman to perform oral sex on him while in uniform.
Daniel MacIntosh, 28, of Brockton, pleaded innocent at his arraignment Tuesday in Brockton District Court. His attorney, Kevin Reddington, said MacIntosh was stunned by the allegations.
``He is very distraught by this,'' Reddington told The Enterprise of Brockton. ``He is a very, very nice young man who dreamed of becoming a police officer.''
According to court papers, the woman told authorities she was too drunk to drive home from a bar last Thursday. When the bar closed, she was unable to reach a female friend who was supposed to driver her home.
She said MacIntosh, who was working a paid detail at the bar, offered to give her a ride. Once they were in his pickup truck, she said, he asked if she could do him ``a favor'' with her mouth since he was doing her a favor. She refused.
MacIntosh then pulled his truck behind a nearby school, saying he had to urinate. When he returned, he forced her to perform oral sex, the woman said.
The woman later called police to report the assault and called a friend. Police obtained a search warrant for MacIntosh's home and truck and seized his uniform and shoes.
MacIntosh was arrested Friday. Mayor John Yunits Jr. said he will seek to suspend MacIntosh without pay.
MacIntosh is a Navy veteran with a young child and pregnant wife, Reddington said
For good reason, when a male officer on duty has to transport a female prisoner alone, before leaving, he calls his station, gives a departure time, and then is logged in when he arrived. Makes false accusations impossible. If he is innocent...as a cop, he should have known better than to put himself in that position..
This is awful. I hope the woman is lying.

The sad thing is that whether the allegation is true or not true, his life and that of his family now lies in ruin.
Does his "working a paid detail" mean that he was in uniform but working an outside job? Since he was driving his own pickup truck and not a police cruiser, would he or shoud he have had contact w/the police station either via radio or cell phone?

Yep, two crimes that people never forget, rape and child molestation. Even if the accuser admits to lying, the stigma will follow him for the rest of his life.
I hope for the sake of his family the girl is lying.
In a just world, any false accusation (of ANY crime) would carry the punishment of the crime that was falsely claimed.

I'm not condoning it, but I thought "rape" was forced sexual intercourse.

I'd suspect the truth is somewheres in between. She was drunk, gave him a consensual BJ..then the next day, she felt bad, used, full of self-remorse..whatever..so she filed the complaint. Many guys weill cheat, especially if given the easy opportunit, but not many will take it to a violent forcing the woman..
I actually did think the same thing when I read the article. I am not sure about Mass Criminal Code however.

It seems oral sex is deemed unnatural sexual intercourse according to Mass law.
So it is considered rape. At least that's my read on it.

Here's the report:
Officials at the private Milton Academy in Massachusetts expelled five members of the boy's hockey team for receiving oral sex from a 15-year-old sophomore girl. A school investigation found that the players requested, and received oral sex, from a classmate in a school locker room last month. Rumors are swirling that the sex acts were reportedly performed by the girl as a birthday present for one of the boys. A school spokesperson could not--or would not-confirm that part of the story. So far, none of the boys have been charged with a crime, although several could be charged as adults under MA law, even if the hummers were consensual.
I suspect that he was at least partially out of uniform during the "rape."
