Life sentence given for fetuses' deaths

LUFKIN - An East Texas man accused of causing his teenage girlfriend to miscarry twins by stepping on her belly was convicted Monday of two counts of capital murder. ADVERTISEMENT

Gerardo Flores, 19, who was prosecuted under the state's new fetal protection law, received an automatic life sentence.

Erica Basoria acknowledged asking Flores to help end her pregnancy, but the 17-year-old can't be prosecuted because of her legal right to abortion.

The defense contended that Basoria punched herself while Flores was stepping on her, making it impossible to tell who killed the twins.

The jury reached a verdict after deliberating four hours. Since prosecutors declined to seek the death penalty in the case, Flores received the automatic life sentence, Assistant District Attorney Art Bauereiss said. The facts were unusual, but the evidence supported a guilty finding, Bauereiss told The Lufkin Daily News.

He said Basoria's family was pleased with the jury's decision, but Basoria, who sobbed as she left the Angelina County Courthouse, had stood by Flores. "It's just tragedy all around," Flores' attorney Ryan Deaton told The Associated Press. "It's a tragedy my client's convicted, I've got nothing good to say about it."

Basoria told authorities that, after about four months of pregnancy, she regretted not getting an abortion and started jogging, skipping prenatal vitamins and hitting her own belly to induce a miscarriage. When her efforts failed, she said she asked her boyfriend to help.

Flores admitted in a taped statement to police that he stepped on Basoria's belly several times the week before she miscarried two boys. He said he punched her during a fight hours before the delivery.

Hope this hasn't been posted already. I searched severl ways.

My naivete allowed me to think that it had to be illegal to hurt yourself. Apparently it's OK if it involves killing a baby. Bear this in mind: if there had not been a baby inside her, the mother's self-inflicted injury -- and soliciting help in doing more -- would have been subject to mandatory 3-day involuntary psychiatric observation. What defined her as being in her right mind was the fact that she was trying to stop the other beating heart in her body.

That this woman could possibly be allowed to conceive again is unconscionable.

How come an abortion doctor, who assists in the murder of babies, is not prosecuted and sentenced to life in prison like this fellow? Murder is murder is murder is murder....

Frankly, I believe they're both cold-blooded murderers. Unfortunately, a majority of the robed oligarchs see it differently.

Agreed! Hopefully she never will, after the trauma she inflicted on her guts in the process of murdering her "blobs of tissue."

This woman is not only a cold-blooded killer, but brain-dead as well. Doesn't she know she could have kept lover-boy out of the slammer by having someone with a medical license do the killing? If there's any justice in this world, this evil act will strengthen the gene pool just a tad.

I meant DELIBERATELY. Consider how this would be legally regarded if there had been no developing baby in her womb.

These are the incidents that the OBLs of the world likely point to as proof of an essential Western decadence that must be brought down. What argument can be made in our defense?

I don't think we need Islam to bring down western decadence.

The abortion issue is very troubling. Whether it's the end of western civilization, I don't know. At this point, it's almost entirely Democrats killing their offspring.

That's what's so darn hard about the abortion issue for me. If the abortionists want to kill themselves into extinction it really seems pointless to try and stop them.

Is it a murder fetish that drives women to have an abortion or what???

This case is about a political perversion of the law today -men are terrible abusers and should be punished as severely as possible - and women are all innocent victims, never to be held accountable for their actions.

To hell with the courts. They no longer seek justice - instead they have been reduced to being the ultimate power of the leftist political machine. They have discarded the concept of fair law in pursuit of their extreme political idealism.

If this is so, why are there still so many of them? Frankly I want to see NO baby murdered by abortion, dimocrat mother or not, but there still seems to be plenty of them left. Must be all the Mexican anchor babies and Puerto Rican transfers.
