Oriana Fallaci is 75 years old. The renowned Italian journalist lives in hiding because of death threats she received after the publication in 2001 of her book The Rage and the Pride. She is dying of cancer. And now she is going to go on trial for “defaming Islam.”

I would let the courts decide if the alleged blasphemy was for real. The general rule should be, in my opinion, that when a speech may be offensive, the speech recipient must be warned. For example, if a book is critical of a given religion and it is clear from its cover, then one who buys the book cannot complain of being offended.

The other test is gratuitousness of offence. It is one thing to be critical of the veneration of the Blessed Virgin Mary in some theological way, another to slap dung on her image.

See my preceding post. I agree, it is hard. But, we managed to convict Martha Stewart on arcane stuff no one can comprehend, - why can't we have someone define blasphemy and still discuss religion? It was done for centuries, until Larry Flynt became a 1st Amendment expert.

I'm for freedom of speech, even if Muslims get ticked off. I've never heard of anyone getting prosecuted for "defaming" another religion. Religious beliefs are fine for those that believe them, but beliefs are not above criticism.

We do not allow communists to immigrate to America, because they want to overthrow our system. How can we let the Muslims come here, when they clearly have in mind the overthrow of our Constitution?

Martha Stewart was convicted of lying to an FBI agent. I don't know if she was actually guilty and make no judgment on her case but the charge she was convicted of was neither arcane or difficult to comprehend. Especially for someone who held a seat on the NYSE (as Martha did)

The complaint comes from Adel Smith, president of the Muslim Union of Italy, who was never charged with defaming Christianity after he referred to a crucifix as a “miniature cadaver” during his 2003 efforts to have depictions of Christ on the Cross removed from Italian schools.

Adel of course, has no problems with "defaming" other religions. He once called the Catholic Church a "criminal organization" and threw a crucifix out his mothers hospital window:

But I think that blasphemy is a serious offense.....

(not being said in an insulting tone) So what??? Blasphemy is a forgiveable offense, Jesus says so. EXCEPT for blasphemy against the Holy Spirit. OF which, the mooslimes have NO part of.

And to carry that blasphemy notion a little further....they consider their koran ABOVE desecration. They riot, kill, maim if ANYONE dares to desecrate/blaspheme/disrespect their silly book. BUT YET, they feel NO guilty conscience when they do it to ANOTHER religion's Holy Book. In fact, they REVEL in doing such things.

Makes them hypocrites. They can go pound sand and call the waaahmbulance when they taste their OWN medicine.

I know that in THIS household, we will be praying FOR Oriana, and EXPECTING that NO weapon formed against her will prosper.

That's a good point. For medieval cultures, religion = politics.

My understanding was, she was convicted on insider trading charges, very difficult to legislate or prove offense. If she was not, pick another example. Milken? My point is, we have immensely arcane laws when we think we need them.

To a Christian, any crime is forgiveable. The issue is laws in a civilized society.

She was convicted on obstruction of justice and lying to investigators. Nothing about her case was difficult to prove. There was a trail of evidence including emails which she and her broker attempted to alter. On top of that the prosecution had a credible witness who placed the call to notify Stewart that the CEO of ImClone was planning to sell his shares. Stewart's only defense was that she had a standing order to sell ImClone if the stock went below $60. It didn't take long to disprove that claim. So, she had inside information and she acted on this informtion for financial gain and later lied about her reasons for selling shares. Easy case.

Paglia talked for a while at the book signing and mainly criticized deconstructionist literary dogma and academic pedantry. She didn't seem like someone who would be a full-blown Said-ist. She seemed very anti-political correctness.

Adel of course, has no problems with "defaming" other religions.

That is why the war with Islam seems so familiar. It's like a fight in elementary school. The kids can call you names, but are crushed when you respond in kind.

Islam fosters an infantile state of thought and being in its adherents.

"I can't believe you hurt my feelings...you filthy cadaver worshiper."

I suggest Muslims be taken to the woodshed. And Islam and its holey Qu'ran to the outhouse.

She lied to Federal investigators. What is arcane about that?

Also I hope you hold the Muslim clerics who screech in mosques about the Great Satan, the evil Jews and Christians etc. to the same standard of blasphemy. But of course the point is moot in their case as anything they write or say will be zealously defended by the left. Which is possibly the case with the judge in Italy.

Don't like Martha's example -- pick another. The point is, we sure have arcane laws when we want them.

I hold everyone to the same standard of civility, and that includes a prohibition of gratuitous, unbargained-for blasphemy, of objects of religious veneration and worship. Speech in a house of worship, e.g. mosque, is by definition intended for the willing audience; same is art displayed in a private museum. Once it spills out to the street, so to say, it should be civil.
