The November election is long past, but I want to tell you about some unfinished and urgent business with which I would like your help.

When my fellow Swift Boat veterans and I made our ads to expose John Kerry’s record with respect to Vietnam during the presidential campaign, we were not alone in our mission. A number of veterans who had spent time in North Vietnam prison camps were eager to tell the American people about how John Kerry’s anti-war activities had affected their treatment.

The two groups of veterans worked together as the Swift Boat Veterans and POWs For Truth. A very important separate effort was “Stolen Honor,” a hard-hitting documentary film made by Carlton Sherwood.

Carlton served in Vietnam as a Marine sniper and won three Purple Hearts for his wounds. He came home to become an award-winning journalist. In “Stolen Honor,” Carlton filmed POWs and their wives talking about how John Kerry’s anti-war activities affected the POWs' treatment.

Carlton also showed some footage of anti-war leftists who worked with John Kerry. Now one of these radicals is suing Carlton for defamation.

I got to know Carlton during the campaign. He put so much of himself into making and distributing “Stolen Honor” that both his health and his finances suffered greatly. But he was so passionate about the cause that he kept on going, and I for one am grateful for the important role that Carlton played in exposing John Kerry’s true role in the anti-war movement...

He's a public figure. He can't be libeled.
While truth is a complete defense - even public figures can sue and win libel judgments when there is "actual malice", known falsity and something else (NYTimes vs Sullivan).

Having said that I think you're pretty safe calling Kerry a low-down, lying sack of cow excrement and rely on the truth defense to keep safe from a libel judgment. ;-)

Kenneth J. Campbell, Ph.D.

Ken Campbell was born and raised in Philadelphia, Pennsylvania. Upon graduating from high school in 1967, he enlisted in the Marine Corps and served as an artillery forward observer with a rifle company in Vietnam from February 1968 to March 1969. After his discharge he joined the Vietnam Veterans Against the War. In 1975, he received a B.A. in history from Temple University. In 1985, he received an M.A. in political science, and in 1989 a Ph.D. in political science from Temple University.

Professor Campbell has taught at Temple University, Villanova University, Ursinus College, Washington College, and for the past twelve years at the University of Delaware. He has been recognized for excellence in teaching by Temple University, the University of Delaware, the American Political Science Association, and the Mortar Board National Senior Honor Society. He has published book chapters and articles on war crimes, humanitarian intervention, the Weinberger-Powell Doctrine, and contemporary genocide. His book, Genocide and the Global Village, was published by Palgrave in 2001.

He is currently an associate professor of political science and international relations and director of the International Relations Program at the University of Delaware. His academic areas of specialization are American foreign policy, international security, contemporary genocide, and global governance.

Prof. Campbell is married, has a daughter, and lives in Exton, Pennsylvania, where he listens to Italian opera, reads mystery novels, and tries to play golf.

I wonder if he meets regularly with Ward Churchill?

I'm thinking that, since a good defense is a good offense, that Mr. Sherwood's attorney should find a way to request Mr. Kerry's full form 180 as part of the proceedings.

Mr. Kerry seems quite fearful of producing any info re his original discharge/separation in 1972. (And any revelations of, say, a bad discharge would resonate widely with even folks who don't follow news or politics.)

Carlton Sherwood, you were brave twice. I'll send some support, we all should consider it.

From Campbell's testimony:

My testimony will consist of eyewitnessing and participating in the calling in of artillery on undefended villages, mutilation of bodies, killing of civilians, mistreatment of civilians, mistreatment of prisoners and indiscriminate use of artillery, harassment and interdiction fire.

So he was with Kerry and watched Kerry and his ilk do do all of these things and he also participated. Sounds like they are war criminals to me...

Although defamation is primarily governed by state law, the First Amendment safeguards for freedom of speech and press limit state law. New York Times v. Sullivan, 376 U.S. 254, 264 (1964); Masson, 501 U.S. at 510. The scope of constitutional protection extends to statements of opinion on matters of public concern that do not contain or imply a provable factual assertion. Milkovich, 497 U.S. at 20 (rejecting categorical exemption of all statements in form of opinion; statement that may imply verifiable assertion of fact is actionable).

The radical leftist anti-American enemy sympathizer won’t win the lawsuit, but he can cost Carlton a bundle in legal fees. I hope the case gets tossed as frivolous.
