Shuma the German Shepard service dog - MO gal will not return beloved pet
KCTV5. ^ | Sept. 23, 2005 | kctv

Posted on 09/24/2005 5:44:30 AM PDT by Former Military Chick

Shuma the German Shepard helper dog. A disabled man from Mississippi who fled after hurricane Katrina and ended up in Independence Missouri needed to put a roof over his families head. His temporary accommodations would not allow pet's.

John Wyrick gave his pet Shuma to Lynn Nevill's at the Independence Animal Shelter where he signed away his pet because he could keep his beloved pet and service dog with him, the apartment would not allow it. Desperate to put a roof over his families' head he signed his registration paper's over to Ms. Nevill. It maybe legally sound but it is morally WRONG.

He has now found a home where he can have his beloved companion and service dog. He went back to the shelter, asking for his pet back and she refused.

This story has outraged the greater Kansas City area. What type of person would do this to someone who has just lost their home and everything in it. Knowing, that his current home was temporary until he could find one that would take pets.

Yes, I know contract law. I also know that he signed away his pet to the shelter. Could he not have asked their help? I do not know that answer. They get strays all the time. Why would they force this family to sign their pet away. This part of the story is a bit fuzzy.

Getting back to this tragic story, the out pouring of help from our town, is heart warming and a reminder of all the wonderful folks out there, they are determined to reunite dog with owner.

Jeff Lund who manages Weinburg Dodge offered after seeing the news segment last night $1000.00 to Nevill if she would return the pet to the rightful owner. The owner of the dealership heard about this and doubled Mr. Lund's offer. Carol Elber's also contributed saying she had little money but this companion belongs with the his family/master. Other's in the community have offered to give Ms. Nevell a puppy, all gestures turned down. Cannot even bribe a woman to do the right thing. What a role model she is.

To add to this devastating situation, the woman, Ms. Nevill, claimed during a radio interview that Mr. Wyrick was not a Hurricane Katrina victim and that there were no records to prove it through FEMA. Well, KCTV decided that when they got involved with this story it would be through the long haul. They also did a check on the man's veracity and indeed he is a victim of the Hurricane. So, in his time of need, she takes his beloved pet and when finds a place to live that accepts pet's she chooses not to give back his service/companion dog. Then she goes out on the air waves to slander his good name.

As of last night's news cast a lawyer has offered his assistance free of charge. Oh and if you are wondering WHY she will not return Shuma, the family pet of the Wyrick family, she claims her family, in the last 3 weeks have become to attached to the dog.

You can also go to the KCTV website, where you can send an email on this story, and they will share them on the air,or call their voice mail where they will also share those messages. The community will have nothing of this and I get it as well.

There is a special place in hell for the likes of this woman. Beloved did little research on the net and he found her address and phone number. I will post the information once I ask Dave where the links are, she must be told her behavior was very un American.

Dog Dilemma Reaction
Kansas City has spoken. You want an Independence, Mo., woman to give Shuma the shepherd back to her owner. Thursday night, you met a disabled man from Mississippi who fled Hurricane Katrina and ended up in Independence, but he had to give up his dog, which is not only his pet but his helper. Chief Investigative Reporter Steve Chamraz has the latest.

Community Reacts to Dog Dilemma
Since the story about one Hurricane Katrina survivor's dog dilemma aired Thursday on "KCTV5 News at 10," there's been an outpouring of reaction to the community. Hear some of the e-mails and offers to help that KCTV5 News received in this video report.

KCTV5 News Investigation: Dog Dilemma
Hundreds of people have come to Kansas City after fleeing Hurricane Katrina and most have been welcomed with open arms. But one man who lost his home and belongings to the storm came here and lost something that can't be replaced and he blames an Independence woman.

I realize there is not much we can do. Aside from writing the news channel. The behavior of this woman is just deplorable. I do not get someone saying that I have had this pet for 3 weeks and my family has bonded with it and it is tough twinkies the original family does not deserve to have their beloved pet returned.

There has been so much kindness and generosity since the day's after Katrina, so should this surprise me, NO, but it does piss me off.

I hope you will join me in prayer that their beloved dog/service dog is returned to the loving family that I am sure he misses he to is a victim of Katrina just like his family.

I get that he signed away Shuma, he had just arrived, he had just lost everything and his temp digs would not allow pet's. But they knew he was looking for a new home where his family could be together, including Shuma.

Not sure why this struck a nerve but it did.

I thought because of the disabilities act that a service dog could not be refused by an apartment.

That's the sketchy part to me.

Was the dog a true "service dog" or is the guy disabled and the dog is his pet. There is a difference. A "service dog" is allowed; the pet of a disabled man wouldn't necessarily be a "service dog."

Either way, the woman's being just plain mean to refuse the guy his dog...unless the dog showed signs of abuse when she accepted him.

He walks with a cane. Shuma assists him. Is he a true service dog, I doubt it but he does aid him in his disability.

As you said, either way, the chick is plain mean.

I was wondering about that. It was not clear if she worked for the shelter. But, to watch in her in the earlier video's she has no concern for the family who just lost everything and so wants their beloved Shuma back.

This has really angered those in the Kansas City area. They feel she is mispresenting those that live here, that her tatics are not the norm. She seems to think it would be just easier if the original family buys a new pet. Goodness gracious.

I just figured this family could use all the positive good wishes and prayers.

Well, if she's got a boss, what the heck is he/she doing? Seems to me the boss could step in and take care of this right away. And I thought shelters often had a clause where if you changed your mind, say if circumstances changed, you could come and get your pet back within a certain number of days.

What a sad tale that need not have happened. Poor man has had to be uprooted and now he loses his dog?
Lots of prayers needed to shake the devil out of Ms Nevill and give her guidance to do what is right!
She states that her family have grown attached to the dog. Big deal. If she is going to be this hard hearted when a person desperate enough to find shelter for his family, she needs to find something else to do with her life. You need compassion for animals and it appears that she has none.
I hope that all the bad press with FORCE her to change her mind.
This has struck a nerve with me too and I am cross-eyed with anger at this woman.

I wonder if there is some way the contract can be voided as having been signed under duress. Or can he get some kind of relief under ADA from the contract? My guess is that it wouldn't take much to get a Judge to go his way; probably most Judges would want to get him back the dog, just need a legal theory on which to do it.

I hope a good old fashioned shaming will wake up this woman and her family to the cruelty of what they have done. Social disgrace can be used in the service of good!

This story smells. The Americans with Disabilities Act forbids discrimination because a person has a service dog. Service dogs are allowed, by law, to go anywhere the person goes.

Not only that, I'd be surprised if the Service Organization that provided this man's dog (he DID get it from a qualified service organization, didn't he?) has a contract that doesn't allow him to sell or give the animal away.

Unfortunately, there are some people who are immune to shame. People can write, picket, and make phone calls, and it won't do any good. The real owner is going to have to go to court.

I don't understand why a service dog was refused in the first place. It doesn't matter. This is a person's pet, and should have been given back to the rightful owner, under the circumstances. The signed paper is problematic, however : (

Thanks FMC. Frequently an initial read of such an article renders an inaccurte conclusion. But I don't believe that to be so in this case. This one, given the reason for not returning the dog, seems to be as terrible no matter how many times one reads it. I wish him well.

A similar story occurred last year, in the San Francisco area, from what I remember. The animal got away somehow (through no fault of the owner, I believe), and the new family wanted to keep it because they became "attached" to it after a very short period of time.

Similar public outrage occurred, and the animal was soon returned to its previous owner. With the outrage expressed here (and maybe some cash to entice this cruel woman to give up the dog), I'm sure the dog will eventually go back to the man who had to evacuate.

The entire story sounds like a TALL TALE load of B.S.!

service dog? for what service? Interesting that this knee-jerk term is used repeatedly with no explanation! Alarm bells for a pack of lies!

These "we love animals more than humans" people have caused more havoc in rescue and recovery attempts than either of the two hurricanes!

"we won't leave without our fluffy" they whine taking up valuable time and SPACE for a human being and food for humans on evacuation buses.

You would rather have a human die than a dog or cat? Then stay where you are because the NUMBER ONE RULE in real survival (not pissy tv shoes) is PRESERVATION of the SPECIES.

That being said - this family made it up there - I would bet that a price was negotiated and fairly and honestly paid (by the Missourian) and after the fact, thanks to a leftist reporter or ASPCA/ELF/ALF terrorist along with some scumbag lawyer - decided this would make a great anti-human anti-America pro-animal fascists (similar to spandex-bike fascists) tale of woe.

Service dog? Another knee-jerk-liberal-leftist term giving human qualitites to animals.

The above is SEMI-sarcasm. The story IS highly suspect. and humans come way above animals when it comes to survival.

A dog takes up as much space as a HUMAN child and probably as much food and water. Animals should NEVER be allowed in a public evacuation facility. For space - for food - for sanitation. Those who cry the most about this dog are the same ones who would care the least the sight of a dead human baby after an abortion.

Actually, it matters a whole lot. John Wyrick stands to be a very wealthy man, and the owner of an apartment building, if Shuma is a certified service dog from an accredited service dog organization.

In addition, the holder of the dog would have absolutely no standing whatsoever in keeping the animal.

FMC, I can tell you that I have a friend with a service dog for her daughter. No one would even think of telling her that her dog cannot go anywhere, it's illegal. The dog wears a special vest and she has a card to show where the dog came from.

This story is not about a service dog, but about a pet.
I'm not sure if the man is lying or the tv station is dramatizing it for ratings, but honestly, when the real story comes out, I think the station will have egg on it's face.

This woman claims the reason for keeping this mans friend is that she and her family have become attached to the animal. This woman hasn't he slightest clue as to how strong the bond is between a dog and it's owner. My understanding is the dog/helper was this mans entire "family". How unfeeling and lacking in even a modicum of common sense can this woman be?

If anyone ever did something like this to me I am sure I would do something utterly stupid and illegal in order to get my best friend back. It seems more then obvious the man was suffering from emotional distress at the time he signed the contract and that alone should make it void. That aside the simple fact that it is the RIGHT thing to do to reunite this poor man with his beloved friend and helper ought to be enough to end this travesty.

I pray that this horrible woman is bombarded and harassed daily, hourly and by the minute for as long as she keeps this man and his faithful friend apart. I own a German Shepherd and have had them all my life. As I imagine something like this happening to separate me and her it brings tears to my eyes and as I further think of it being a willful act to keep us separated, I also feel complete outrage.

I believe God has a special place in his great heart for his creatures and especially for mans best friend. I further believe that this will, in the end work out and Shuma will go back where she belongs. I further believe that this woman will pay a great price for what she is doing.

I get the impression that the author used the term "service animal" very loosely here, which is causing all the confusion. Had it been a true service dog, he could have gone anywhere his owner went.

That being said, what a BEOTCH this woman is. She took advantage of a disabled man in a desperate situation. I hope she is shunned by her entire community, and is shamed into giving the dog back.

If the story is true, I have a feeling she won't be able to deal with the bad publicity and will give the dog back. And her employer better lean on her, because publicity like this just CAN'T be good for business.

Dogs have been trained by their owners to help disabled people for centuries-LONG before there were service dog agencies. Charles Dickens describes a dog guiding his owner, a blind beggar, in his 1840s (A Christmas Carol. Also, someone once aptly described dogs as "workaholics forced to be couch potatoes" . This means that dogs (domesticated wolves) want to be useful to their pack-they want a task to perform. All most dogs are asked to do is lounge on the sofa being cute. But a dog as intelligent as a GSD would not only have a strong desire to aid his disabled master-he'd have the intelligence to figure out ways to do so. It's quite possible that this dog, while a pet and NOT a trained service dog, DID perform little tasks that helped his human. Maybe picking up dropped things and bringing them back to him so he wouldn't have to stoop down, maybe supporting his master with his weight on the weaker side-stuff like that.

Whether the dog is a trained service dog or not is irrelevant. The dog did aid his master, at least by his love and devotion, and he and his master are bonded. It is heartless and cruel and vile for the witch to keep the dog and his master separated because she and her horrible family have "bonded" to the dog, after a mere three weeks. Sadly, it does not sound as if the ADA will be able to help the man-if it's not a registered service dog, I don't see how they can become involved, either against the Neville thing or against people refusing to rent to a dogowner. But with a pro bono lawyer, I believe a judge will be able to void the "contract" here, as the man(having fled from Katrina)was obviously under duress, as another freeper pointed out above. I hope so anyway. Hopefully, a little public shaming will and fear of bad publicity will make the Neville creature retract her harpy claws from the dog and return him to the rightful owner.
