Three roommates were comparing their handguns in the drive-through of a fast-food restaurant Tuesday when one of the pistols accidentally discharged, killing a woman in the front seat. Police identified the victim as Teaira Richard, 19, 10769 Alco St., Apt. 3.
Nicole Latrise Daniels, 20, who listed the same address as Richard, was booked into Parish Prison on one count of negligent homicide. Bond was set at $40,000.
The incident happened about 3:30 p.m. at the Popeyes at 10706 Florida St.
Daniels was in the back seat looking at a pistol one of the other two roommates had just bought, police spokesman Cpl. L'Jean McKneely said. Another girl handed Daniels a second gun, and as she was looking at both of them, one accidentally discharged.
Richard, who sat in the front passenger seat, was struck in the upper back, McKneely said.
The third roommate, whom McKneely refused to identify, drove Richard to Earl K. Long Medical Center, where she was pronounced dead.
Loaded or not, it had a round chambered! (Assuming it was an automatic. If it was a revolver, they should up the charge to willful murder.)
When I was in the Army, I worked as a Battalion S-2 clerk (Soldier of Paperwork, Elite Combat Typist Section) in a Pershing Missile unit in Germany during the time of the Bader-Meinhoff nonsense. When I reported for work there was a loaded M1911 in desk drawer, which stayed there for my entire tour.
Surprisingly, It never once accidentally went off.

A gun is considered loaded if there are rounds in the magazine/clip. However, it is not "ready to fire" unless a round is chambered.
I wasn't questioning you, only stating my limited experience. It would seem a little too easy to avoid by simply ducking below the window to attempt an armed robbery that way.

Yes, you're right. It's also "loaded" if there are no rounds in the chamber but rounds in the clip or magazine. The laws are pretty clear on that in all 50 states. Here is a snippet of the NY State law as an example:
A loaded handgun may be carried in a vehicle by a properly licensed individual. ("Loaded" means loaded in magazine or chamber. A loaded handgun means one for which the person possesses ammunition.)

Agreed. Having ammo for a gun and having a loaded gun are two different things entirely.

The gun was loaded and sitting there, just ready to ambush an innocent victim. It fired itself and we have to sue the gun manufacturers but can't because the Evil NRA and the Evil George Bush signed a bill preventing the "victim" from doing so.

not really, a lot of drive thrus are so close that the driver can reach in and shoot anyway. you are realkly exposed in one of those.
Yep. I have been around a lot of guns in my life time, and never has one accidently discharged. In order for a gun to shoot, you need to pull the trigger. Im not sure of the age requirements for possessing a handgun in Louisiana, but it does not mention anybody there being over 21 (most states have 21 for handgun i believe). It only mentions 20 and 19. Either way, thats all a side note. Sad the person died, but it wasnt because of a accidental discharge, it was because of stupidity.
