Just remember most of the people who opposed Miers were the same who opposed Roberts and oppose everything the Preisdent does. They hate him just as much as the kook left does which is why they sound more and more like them every day.

There's a lot of truth in what you say.

However, if there isn't some compromise by all parties, it is possible that no one will be confirmed, and this selection will be left to the follow-on administration.

Thats absurd. Nixon's nominee Fortas went down in 69 and Nixon won with a landslide in 72. If Bush nominates a good strong candidate and it gets confirmed it will be like harriet Miers never happened.

That's rich. Miers withdrew because of all the spoon banging on highchairs. It wasn't acceptable to allow the confirmation process run its course.

Probably true, but him being head of the Judiciary committee is reality.

Ir the goal is to have the PResident make a "bold move", or make a "statement", he can certainly do that with certain picks. Those might not be people who get confirmed, but at least he'll have made a statement.

For whatever that's worth.

I'd like to recommend Judge Diane Sykes. She is a true conservative, was put forward for US Circuit from Wisconsin by Senators Feingold and Kohl, both of whom sit on the Senate Judiciary Committee. She was confirmed overwhelmingly just a couple of years ago by the entire US Senate. They'd have a hard time explaining why they gave her a pass then and want to filibuster now

Yes, I believe it was the right decision. I do respect Miers for doing so and also the President for accepting the withdrawel.

The reasons given by Miers are precisely the reason she should never have been lofted in the first place.

With little to base a decision on, the Senate wanted White House papers. That would have impacted the ability for White House counselors to provide good advice to presidents in the future, always wondering if that advise would later be revealed in public, or impact their possible future nominations.

I have thought Miers nomination was a flawed choice from the start. I am glad to see Bush get a second chance on this one.

Yes! I would love to see that.

One thing, of course, is that the press would never give them the time of day for that, though. By contrast, the leftwing press has been crowing over opposition to Harriet Miers, and there have been front page articles in my local NYT paper quoting the inflammatory remarks made by some conservatives. That certainly wouldn't happen if they were attacking Joe Wilson. The press loved this GOP-eats-its-own scenario and has done everything possible to magnify it.

Brown is a judicial activist with a long history of legislating from the bench to "correct" social crisis.

This is exactly the kind of candidate and Justice we need.

I don't know about that. There were a lot of folks on this db that were very upset with the pick. I do not consider them pundits but expressing a point of view. I think a lot of the base was expressing concerns and the pundits picked up on that.

Take it from a conserative in Canada who watched the leaders fracture the conservatives for 10 plus years at the federal level over a variety of issues. Its not a good move to fracture the base. Bush43 did the right thing here. He now has a chance to ensure the base stays united and move forward.

Oh happy day...

Now he has to appoint a true conservative. He saw how pissed off his base was with this one. Five+ years of standing behind this guy, electing him twice to the White House, and this is the lady with which he repays our loyalty? This lady is his conservative legacy to the Supreme Court and the one to shape judicial discourse for decades to come? I don't think so.

That being said, I do kind of feel sorry for Harriet. She got absolutely skewered. Some of the things being said about her (especially that she was not that bright) had to be hurtful. But she did the right thing and she did it quickly. I thank her for that.
