He also noted that Jessica left the Covenant Christian Academy with a 3.5 GPA and a 98 in religion class. The family has since moved to Pennsylvania.And her GPA has what to do with anything? I wonder if they moved to Beaver County?

Agreed, and they also have on their side, the fact that the school outed it as they did. If this happened in the hallway on campus, the school could fall back on it's principle policies, the fact that it happened off campus, and the expulsion was according to open gossip, I think the school got it's tit in a ringer over this one...

I repeat my last; with emphasis:
"What Jessica did is not expressly forbidden in Scripture and a legal contract cannot be based upon vague principles of divine revelation," Clark said. I'm not defending her - I merely posit that the school's code of conduct HAS to have it clearly in black-and-white what their policy is, and has to be able to unambiguously back-up each and every point for it to hold up in a court of law.
They CANNOT declare a point and then say "well, [thus-and-so] is what we feel Scripture says" after-the-fact. If they don't want 'same-sex kissing' then that should be enumerated in their policy. The Court understands the criminal code and state statutes; it does not understand the policy-writers' intent or their personal interpretation(s) of Scripture.
Was this sleepover a school-sanctioned event? And what is the school's "standard of conduct on "sexual immorality" " word-for-word?

Not true.The parent signed a contract when he enrolled the child.A Covenant school is one that is based on a contract(covenant).At least one parent is required to be a professing Christian and the student agrees to uphold the schools stated beliefs both on and off campus.

This is America. If she wants to be a lesbian, she is certainly within her rights to carry on in such a manner. But, what she is not allowed to do is force a private institution to change rules to which she obviously agreed to adhere when she enrolled. In short, she can munch carpet all she wants, but not at that private school.

It also makes sense that a private institution can enforce its own rules, regardless of their basis of origin.
