I think the old dead white guys who wrote the Constitution had no concept of the government spying on its citizens electronically ....

In Kelo, they argued that Fifth Amendment "public use" takings also applies to public "good" that increased taxes brings. I don't recall, but did the Supreme Court discuss the Fourth Amendment protection to be secure in one's home as a counter to governemnt takings?

I got as far as the 2nd sentence:

"The advocates of a constitutional right of privacy speak as though that right were expressly stated and enumerated in the Constitution. But the text of the Constitution does not contain the word "privacy" or the phrase "right of privacy."

Any idiot that doesn't understand that our rights do not have to be enumerated to exist is not worthy to sit in judgment of anything other than perhaps 'the best of breed' at the county fair.

here is an interesting take ...."a rehearing, however the case is decided, could only be a setback for the left: Either Roe v. Wade is overturned, and the left is hoist on its own petard of creeping government intrusiveness, or Roe v. Wade is confirmed, and in fact is used as a precedent to strengthen the privacy right and thus provide a basis for overturning other statist regulatory infrastructure. I am rooting for the latter.".....http://www.coyoteblog.com/coyote_blog/2005/08/implications_of.html

There is nothing "Private" about abortion.

There are nurses, doctors, counselors, secretaries, pharmacists, FATHERS, HUSBANDS, RELATIVES, whoever drives you to the clinic and the government WHO FUNDS THESE CLINICS AND obtains the statistical information on abortion.

PRIVATE....Yeh, right.

Where in the Constitution does this guy find authorization to conduct a national referendum?

The purpose of the Constitution is to establish the powers of the Federal Government, NOT to enumerate the rights of citizens. The fact that a "right to privacy" is not enumerated is irrelevant.
Unfortunately, this got lost somewhere along the way.

And the "right to privacy" has nothing to do with abortion, which is covered under the Fifth Amendment which says that no one shall not be deprived of Life, Liberty or Property without due process of law...

It would appear to me that there is a God given right of privacy just as there is a God given right of every man to obey his conscience in matters of religion and to acknowledge that God alone (never the government)has exclusive authority over matters of conscience, including the authority to advise or recommend with respect to the duty that is owed to the Creator.

I would hate to think how this guy would feel about free speech, media, religion etc if the constitution wasn't passed without an understanding that the Bill of Rights would be added. The framers, who I think most would recognize as smarter than the average bear, didn't feel it was necessary to enumerate rights at all.

And before the right to privacy was used to justify abortion, if it had been brought up as a possible amendment it would have passed without much trouble. Even still I think it would pass, but a lot of people would be against it just over abortion.
