"Arlen Specter, Republican chairman of the Senate judiciary committee, said on Wednesday he was drafting legislation that would require the administration to seek a ruling from a special US intelligence court on whether the spying programme was legal."

I wonder if the President will sign or veto that legislation.

Specter has already said that FISA might be unconstitutional as it interferes with presidential poweres. I think he is going to have it proved.

This is a leftest article that Arlen set up a week or so ago, by his comments. They are using him like a pig at a barbecue roast to get at Bush.

Congressional Republicans. . .where are the real ones; and why don't deal with these fraudulent Repubs; who would rather have their back scratched by a Demrat. . .than support the President.

Is that 'Leftist shadow government' i.e. CIA elements - putting something in the water to push these Rinos 'over the top' or what?

I can't grasp the concise decision here. I guess that's the first thing they teach in law school, how to write so no one understands what you are saying.

I'm pretty Arlen (Dershotiwz) isn't speaking for the people he uh, "represents", and I hope to hell the final vote tally proves it too!

It's past time to get letters, emails, and telephone calls going. Washington air must be so polluted that they've all lost their minds--or whatever minds they had to begin with.

That's what I was wondering. If the Rats and Rino's got something passed and the President refused to sign it then the Congress has no power to force anything.

"The ruling represents a setback to the American Civil Liberties Union and National Association of Criminal Defense Lawyers, which had filed briefs opposing the government's position, but there was no immediate decision whether the case would be appealed to the U.S. Supreme Court"

Also represents a big set back to the Democrats....good find Howlin!

If the Rats arguments held any water then because FISA has no exception clause for Presidential Authorities then FISA becomes unconstitutional because it can't trump the constitution without a constitutional amendment. Jimmy Carter couldn't handle his obligations so he tried to pass it to the Judiciary.

"domestic surveillance of Americans"

Hogwash. It's not domestic surveillance and it's not being targeted at Americans.

It's been clearly stated by the Administration over and over again that this program ONLY deals with cases in which one party is international and in which there is reason to suspect that the communication is terrorist related.

"The President has the power under the Constitution."

I agree 100%!

What we have is the Congress trying to cement the usurping of Executive power that began during watergate.

Another divide-and-conquer article designed to split the GOP. What a surprise.

Most GOP Congressman know that if they oppose the President they can kiss their re-election goodbye.

The President is giving the Rats a little breathing room in order to allow themselves to squirm away from their previous allegations. I'm pretty sure there's something the President wants in return like permanent tax cuts or Patriot Act without exclusions?
