Well, we don't call them spies.

We call them unlawful combatants.
As far as that being a gray area in international law, I suppose it is, but thats the way they played it

As far as calling everyone spies or even unlawful combatants because they were not all wearing uniforms, well, we didn't and thats why they aren't all dead, at least by us.
Those captured were vetted and we culled out those that we needed to round up and detain, and released the rest or turned them over to the new government.

The Taliban got their asses kicked and the survivors fled or were killed by other Afghans.

There aren't all that many there, considering the many actions in this ongoing conflict and I wouldn't ever release even one of these fine fellows.

And don't forget that they specifically target civilians. Certainly that's not what a legal combatant would do!

Good point. That alone would make them War criminals, but I wouldn't trust the Hague tribunal to walk my dog, as far as prosecuting real criminals..

We can't afford to cut ourselves off from the international community. The UN stands for concensus and the international rule of law. If we don't comply we will find ourselves in big trouble down the line.

you should tell this to the Darfur victims of the "killings carried out with genocide intent". Oh, sorry, you can't--because they are DEAD!!!!
