U.S. Senate Bids to Ban Emergency Gun Confiscation

But one prominent Democrat, among others, is opposed

Updated: July 24th, 2006 05:07 PM PDT

Sen. Edward Kennedy (D-MA) charges a Republican-backed amendment that prohibits the confiscation of guns during an emergency puts police officers and first responders in danger. The amendment, sponsored by Sen. David Vitter (R-LA), was added to the Homeland Security appropriations bill during a July 13 Senate vote.

During the rescue and response after Hurricane Katrina police officers and first responders had to pull back from rescuing victims because they were being shot at by snipers. The amendment "prohibits the confiscation of a firearm during an emergency or major disaster if the possession of such firearm is not prohibited under Federal or State law."

Kennedy accuses the Republican leadership of backing "another special-interest, anti-law enforcement measure that strips away the rights of law enforcement to respond to public safety emergencies."

Kennedy also accuses the National Rifle Association of setting the Senate's Republican agenda. "This proposal is part of the NRA's nationwide campaign to target the nation's Mayors and Police Chiefs. With fear tactics and inflammatory rhetoric, the NRA is looking for pledges that the people protecting our communities will never confiscate a weapon during a natural disaster. The NRA's perverse response to the devastating tragedy caused by Hurricane Katrina has been to launch an aggressive fund-raising campaign to undermine the very law enforcement and public safety officials who protect us during times of crisis," Kennedy says in a prepared statement.

But Republicans were not the only backers of the amendment. Several key Democrats also voted in favor of the provision. Democratic Sens. Robert Byrd (WV), Barack Obama (IL), Ben Nelson (NE), Bill Nelson (FL), John Rockefeller IV (WV), Evan Bay (IN), Jeff Bingaman (NM), Russ Feingold (WI), Patty Murray (WA), Joseph Biden (DE), Patrick Leahy (VT), Joseph Lieberman (CT) and Mary Landrieu (LA) all voted in favor of the amendment.

Too bad Kennedy can't be banned, or his aquatic "automobile".

What they should do is add to this provision that the County Deputy can "Deputize" these gun owners to act as a security force, much like a County Militia.

In fact having a county Militia to help in times like this is an idea who's time LONG ago came and for some reason, went.

Hi All-

I would love to hear Senator Kennedy's twisted logic on how a law-abiding and decent citizen suddenly becomes a "threat to police and first-responders" in the event of a storm or other natural disaster. Hopefully that crackpot will retire from the Senate soon.

Never happen. It's easier to disarm the honest and innocent than fight the lawsuits of the guilty who get popped looting.

It's time the 'innocent' began to resist, by Force, any jerk wearing any uniform that tries to violate their constitutionally protected rights. Whether under the color of law or not.

Ping to article on effort to prohibit gun confiscation during an emergency or natural disaster.

I know some activists here who are working to initiate such a measure on the state/local level. Yall know anything about existing local laws on the subject?

Also, let me know if you're interested, and I'll freepmail you more info on the petition.

Criminals don't obey laws. Why is that such a difficult concept for the likes of Kennedy to grasp? Pass a law and who will obey it - answer: law abiding citizens. Confiscate guns? Who do you confiscate from? Law abiding registered gun owners. Confiscate from criminals? How? Where? If they could confiscate from criminals WHY DON'T THEY DO THAT NOW??!!???!?!? This would ONLY disarm the law abiding and leave the criminals COMPLETELY untouched!

In 1988, Marylanders could vote for or against a gun law banning so called Saturday night specials. The then governor of Maryland, William Donald Schaeffer, actually came on television in a commercial for this gun ban and held up a Saturday night special and he actually said ".. this gun can only be used to commit crimes - if you try to defend yourself with it, it won't work".

He was, of course, referring to the indisputable fact that the evil gun will take over your mind and force you to kill people at random unless you have the Jedi-like mastery over guns that only police or military training can give you.

A female reporter after Columbine was talking to one of the students at Columbine - the student said: "I do some hunting and boy, I sure wished I had my hunting rifle with me...". The female reporter commenting about that student said: "Oh, thank goodness he didn't have his gun too - that would have made things so much worse". Again, in the presence of the other evil being committed by those other students, this particular student wouldn't have stood a chance of being able to control his rifle.

These people clearly have a serious mental disorder. I'm surprised they haven't yet demanded that firearms actually be placed in prison cells instead of the innocent men whose minds were controlled by them.

Thanks; I suppose that should have been obvious, but I've had no coffee today.

Btw, anybody post the NRA's original announcement on the truth about this? NRA-ILA

emergency puts police officers and first responders in danger

You can't have it both ways (unless you're liberal gun grabbing neo national socialist piece of sh!t like Kennedy of course) Either, "police put their lives on the line for us every day" or they are the government's sacred bully boys who never to go in harms way. Which is it? (Hint - Think about how the Columbine swat team reacted)
