Student can wear Bush-mocking T-shirt: court

A US student who sued school officials after he was made to censor his T-shirt that labelled President George W Bush "Chicken-Hawk-In-Chief" and a former alcohol and cocaine abuser won an appeal yesterday to wear the shirt to school.

The 2nd US Circuit Court of Appeals ruled in favour of Zachery Guiles, who through his parents claimed his free speech rights had been violated.

School officials made him put duct tape over parts of his T-shirt that showed a Bush image surrounded by cocaine, a razor blade, a straw and a martini.

Guiles, who as a seventh grader in 2004 wore the T-shirt to Williamstown Middle High School in Vermont once a week for two months after purchasing it at an anti-war rally, appealed the case after a lower court ruled in favour of the school.

The school argued the images were offensive because they undermined the school's anti-drug message.

The T-shirt read "George W Bush" and "Chicken-Hawk-In-Chief" with a picture of the president's face wearing a helmet superimposed on the body of a chicken.

The back of the T-shirt showed lines of cocaine, a martini glass and smaller print that accused Bush of being a "Crook", "Cocaine Addict", AWOL", "Draft Dodger" and "Lying Drunk Driver".

The appeals court said while the T-shirt "uses harsh rhetoric and imagery to express disagreement with the president's policies and to impugn his character", the images depicted "are not plainly offensive as a matter of law".

The court agreed with the lower court that ruled Guiles' suspension from school should be expunged from his record.

you have listed a number of rules that were common to schoolchildren then and are common to schoolchildren now.

Clearly, that is not the case. If it were, there would have been no lawsuit and no thread.

However, the have nothing to do with the legal issue in this case

The point was.....30 years ago, there would have been NO legal issue and NO case.

(and I have no idea what any of it has to do with abortion).

Nothing to do with abortion other than when our judicial tyrants granted abortion "rights" the country as a whole began to go downhill rapidly. Children that were granted the privilege of birth suddenly were given "rights" that up to then adults didn't have. The anti-war, free-love hippies of the late 60's/early 70's were behind the degeneration of our society.

Many of them are the leaders behind the anti-war, anarchist movement of today.

The worst part of FR to me now is the ones who are supposed to be on our side who are more than willing to hand this country over to the liberals to "teach the GOP a lesson."

Yes, that is worrisome. I doubt that if/when it comes down to it, they will do it. However, the GOP should start listening to the folks and get the message before it comes to that.

Would his free speech rights been upheld if his shirt said F*ck Hillary or Fags must die? Hmmmm? Free speech for kids is a load. They're not considered adults, they cannot vote nor refuse to go to school, nor a host of other things adults can do, or not do. This is insanity.

And I (GASP!) even had a paddling or 10!!! And I happened to turn out just fine-at 48 never have I even seen the inside of a jail cell. And I don't ever plan to.

The only bright side I see is that he's just about at the age where he'll start to rebel, and since his parents appear to be as far out there as it gets, the only way he can rebel is to become an America-loving, pro-capitalist, preppy Reaganite conservative :-p

Unfortunately for FReeper parents, our kids become idiots even though they should know better. My 14 year old defends Islam. :::sigh:::
