A stray bullet from an upstairs room wounded a Buffalo man Sunday morning while he was using the toilet in the Buffalo Tourist Lodge, 1159 Main St., police said. Walter Her, 68, who had been living at the hotel for several months, was treated in the intensive care trauma unit of Erie County Medical Center for a wound to the lower left side of his back.
His condition was unavailable late Sunday, but his injuries are not believed to be life-threatening.
"Two guys and a girl were upstairs partying, and they say they found a gun in the room when they checked in. One of the three fired the gun, which went through the floor, through the ceiling, through the bathroom wall and hit the guy," said Detective Sgt. Tom Donovan of the Central Police District.
The three were arrested, and police recovered a High Point .40-caliber semiautomatic pistol. Police said that the girl was 16 years old and that the two men had consensual sex with her.
"She was a willing participant in the [statutory] rape," said Donovan. "The two men said they met her Saturday night at a bar on Fillmore. . . . They said they didn't realize she was underage because they were carded to get into the bar."
Donovan said police do not believe their story about finding the gun in their room and believe one them brought the gun there and accidentally fired it.
John E. Kidd, 23, of Louisiana Street; Michael R. Morris II, 22, of Buffalo; and the 16-year-old girl, whose identity was withheld, were each charged with two counts of criminal possession of a weapon and one count of assault.
The two men also were charged with statutory rape and endangering the welfare of a child.
The shooting took place at about 4:30 a.m., but Her didn't realize he was wounded at the time, police said. He went to bed and, at about 7 a.m., discovered that he had been shot. He walked to the hotel's front office and was taken to ECMC.
The odds of getting shot on the toilet finally caught up with him.

I went out to watch the Patriots vs. Bills a few years back, and we always stay at the diviest motels. You can party a bit harder and nobody cares...:)
The four days we were there, there was a fully loaded black Ford Taurus parked a few rooms over, tan leather interior, really outfitted nice and all. Had the windows down the entire time, poured rain a few days, but we paid it no mind.
When we were getting ready to leave, the little lady with one leg who ran the place asked us to look in the room and tell her what we thought...said a man and woman checked in, but left at some point without paying for additional nights. The car was still there.
So we go in, and there in the middle of the floor, is...a big circular dark spot in the rug...! I looked at that and thought "uh...uh oh."
The old lady was griping that they used some kind of smelly cleaning fluid on it, and while she is talking, we notice a pile of clothes on the floor. Womans clothes. Bra, underwear...all covered in a fine white powder.
I said to the guys I was with "Let's get the hell out of here! This place looks like a murder site!"
So we are getting ready to drive away, and I look around...where is my Pats drinking cup?
I left it on the dresser in the "room"!!!!!!!!
I ran back in and grabbed it. We looked at the local papers on the Internet for a few days, but didn't see anything. Gulp.

Now that is a hotel I would stay at, they put guns on your pillow instead of mints/chocolate.

Aside from the crappy comments I have swirling around in my head, I do have a semi-lucid question...
If she was in an over-21 drinking establishment, how is it the men can be guilty of statutory? If they had to prove their age, it is more than reasonable to assume she did, as well, right? Therefore, they should be on safe legal footing for their assertion that they committed no crime because they were convinced she was of legal age.
The bar, however, should have some trouble for its lack of control over its patronage.

Never, never stay at a hotel without a bulletproof terlit. First thing I check. Well, after the porn on the movie box, that is.
