Just heard the ABC News report at the top of the hour and now it appears that they're going after at least two Republicans and possible one Democrat who knew about Foley and his fetish for little boys and tried to cover for him.

I'm betting that if the GOP can pull a Torricelli here (and Florida has a late primary date), the the new nominee will be state Senator Jeff Atwater.





FL Primary was already held on Sept. 5

Can someone refresh my memory but I could have sworn I'd heard Rush mention a couple of months ago that there was a rumor of a House sex scandal that was going to break late this summer. Does anyone else remember hearing this?

The GOP party just picks a candidate, and he, Deus ex machina, is the nominee, running under Foley's name. Atwater lives in North Palm Beach, which IS in the district.

Here is the statute:

"4)(a) In the event that death, resignation, withdrawal, removal, or any other cause or event should cause a party to have a vacancy in nomination which leaves no candidate for an office from such party, the Department of State shall notify the chair of the appropriate state, district, or county political party executive committee of such party; and, within 5 days, the chair shall call a meeting of his or her executive committee to consider designation of a nominee to fill the vacancy."

Whomever the executive committee names is the nominee running under Foley's name. Of course, I am not sure there is such an executive committee for a multi county congressional district. That may be a lacunae in the law.

What I meant by the post was that because Florida has a late primary date, it's still possible to find a substitute candidate now that he's withdrawn.

It sounds like whoever the new GOP nominee will be, he or she will have to run under Mark Foley's name. Very odd law.

I would just like to know what the GOP leadership knew about this situation and when they knew it. Was it six months ago? A year ago? When? To have a guy like this in the US Congress in the Republican party with legislative responsibilities is a terrible travesty.
IF the leadership knew about this and didn't bounce this pervert out, they deserve to be booted out themselves -- from the Speaker on down!!!

The GOP House Whip was just on television saying he wished Foley "the very best." No expression of dismay or outrage or concern for the young innocents who may have been molested, but the Whip is wishing the perp abuser the best! Get OUT!

Your post sounds like you are very familiar with Florida law. I am not. Would you say that this "designation of a nominee" has to be from that district? Could Tom Gallager, for instance, be nominated?

I don't know what the residency requirements are under Florida law. In Texas, if you are a resident on election day, you are good to go. Some states may have no inter district residency laws. But even if legal, if someone parachutes in, then the carpet bagger issue is out there.

You are of course absolutely right. We do have a problem in the country and obviously it is in the Republican party to allow a pervert like Foley to stay in office when it seems that a whole lotta leadership and staff knew exactly what this guy was all about. It is disgusting. It will also cause conservatives to not give $$$ to the party if they think that perverts like Foley are allowed to be in positions of power. I, for one, want to know about this case and will hold accountabilities.

I wouldn't call 16-year-olds "young innocents." They may have been led astray, but doubt that they didn't know what was going on. Also, you're assuming physical contact, there may not have been any...it may have all been "cyber sex."
