Democrats Tell President Bush: Don't Propose Judges Against Abortion

Washington, DC (LifeNews.com) -- Now that the elections have given them control of the Senate, leading Democrats on judicial issues have a message for President Bush. They don't want him to send up for confirmation any judges who would be hostile to legalized abortion or they plan vote down or filibuster them.

Democrats now have 51 votes in the Senate and will likely have a slim one vote majority on the Senate Judiciary Committee when Congress starts its new session in January.

Though they technically have enough votes on the panel and in the Senate to defeat any Bush judicial pick, they may still have a tough time keeping their caucus together as some moderate Democrats joined a group of Republicans in making sure filibusters weren't used to hold up nominees.

But leading pro-abortion Democrats tell Bush he needs to pick someone without a record opposed to abortion in order to get judges -- especially for the Supreme Court -- confirmed in their Senate.

Sen. Patrick Leahy, a Vermont Democrat, told Newsday that Bush should nominate only "consensus" nominees.

Sen. Charles Schumer, of New York, was more strident and vowed to block any nominee he feels is too extreme on abortion.

"We will do everything in our power to see that that happens," he told Newsday, saying filibusters should be expected. He added that Bush "will have to negotiate with us, because we'll have the majority."

There are no current Supreme Court openings, but pro-abortion Justice John Paul Stevens, who was the subject of retirement speculations shortly before the elections, is 86 years-old and battling significant health problems.

Ruth Bader Ginsberg, another abortion advocate is 73 years-old and has her own health concerns.

Had the GOP kept control of the Senate, the liberal judges may have waited to retire, but they could step down feeling that the chances they would be replaced by a less conservative judge are higher with Democrats heading up the chamber.

How Bush reacts to Democratic control may be seen in whether he chooses to re-nominate six conservative appeals court judges who have yet to be confirmed.

Should a Supreme Court opening develop closer to the 2008 presidential elections, that may put more pressure on Senate Democrats to hold off on confirming a replacement until afterwards.

It wasn't in the mainstream news AT ALL until the Constitutional option was brought up.

The President has a bully pulpit...if he wanted he could make a big deal out of it every time they turn one down.

May their power mongering land them in the tiniest of confinements with the least power over even the lowest around them. May the janitors and maids around them have power over them.

If possible and fitting because some shred of them seeks you, please save their souls. But, Lord, Please save our land from their evils, as well. Remove them from public life with great noise and publicity on a par with all their lies and evil noise.

The problem is that the Judiciary Committee can prevent the rest of the Senate from getting to vote. A few thousand votes in two states (Montana and Virginia) and the Republicans would still have a majority in the Senate.

The most important vacancy is one the Gang of 14 has no control over--the next vacancy on the Supreme Court.

Yup...that's a big part of why DeWhiner lost in Ohio.....voting as a Democrat so often that he was an embarassment. (With Sherrod Brown, you KNOW how he'll be...since he's basically a communist).

You forgot to thank the stay at home - teach the GOP a lesson voters. Bush got two good conservative judges in spite of the people you mentioned because we had majority. Now we don't have a prayer.

What is the composition of the Judiciary Committee - any swing votes?

The tactics that must be used are to twist the arms out of the sockets of the "Blue Dog" Democrats. I know they're lying about being conservative, the rest of the people here know they're lying - but they should be forced to live up to the "conservative" title they've stolen.

Maybe so, but in what circumstances would Reid & Co. lead a filibuster? They are in control. They aren't going to filibuster a vote they know they will win anyway.

Stevens and/or Ginsberg will not leave until the Democrats are sworn in as the majority...that's the way the "impartial judiciary" operates.

if we had used the nuclear option last year - we would have lost the ability to use the fillibuster next year, when we are the minority.

in the end - the gang of 14 got us Alito and Roberts, and we could not have done better with those two picks.

Very stupid of the RATS to try and make being pro-abortion such a prominent qualification, especially before there is a nomination. They will lose support if they try to force their litmus test on the President's nominees.

Hey Bush, nominate the most pro-life judge you can find that does not mind their life being put under a microscope. This media attention will take the heat off of any "investigation" they want to launch. This will cause considerable infighting as the House and Senate egos will not allow them to suffer someone else in the spot light.

I don't exactly disagree, but now that the Dems have a majority, they won't have to "say no" at all. They just won't say anything. The nominees chosen for doom simply will never get hearings and/or will not be reported, even unfavorably, out of Leahy's committee.
