Smith's Lawyer: 'DNA Check not necessarily conclusive...'

The bizzare saga of Anna Nicole Smith just got stranger. Two of Smith's lawyers are on TV now answering press questions. Birkhead's request for an emergency DNA test of the baby has been denied. When one of Smith's lawyers was asked about the ruling, he said that 'DNA is not necessarily conclusive,' which is news to me. Both Birkhead and Smith contend that they are the baby's father, and the two most likely executors of a fortune worth $1.6 billion.

The judge ruled he cannot rule on any emergency petition because he believes the case is under Bahamian jurisdiction.

One of Smith's attorneys then got even wierder by saying that 'there as some allegations that the baby's hair has been dyed,' suggesting an attempt to alter its appearance re. paternity.

This case looks like the Tabloid Full Employment Act of 2007. I feel bad for the baby.

Perhaps the networks can get Nifong on as a consultant. I doubt there's anyone else out there who would be as qualified in providing commentary about monkeying with DNA results...

You are right: DNA is conclusive. Plus, the two purported fathers look NOTHING alike: one has dark hair, light eyes, and a big nose; the other has sandy hair, sandy eyes, and a pug nose that even before it was (probably) fixed, would have been smaller than the other guy's schnoz. My point is that it'll probably be evident soon, just by eyeballing the baby, which guy is the more likely father.

The emergency request was for ANS dna, not the baby's.

I saw Stern's lawyer on FOX, last night. What he means about DNA not necessarily being conclusive is that the biological father is not necessarily the legal father. Evidently, in the Bahamas, the name on the birth certificate takes precedence over the biology.

I don't think we're going to be seeing that baby anytime soon. If that baby was in the Bahamas yesterday, I'd bet a lot of money she is no longer there and only 1 or 2 people know where she is.

I guess they figure a guy could just temporarily "borrow" some other guy's DNA for the night. These kinds of shysters will say absolutely anything for a buck.

That baby is destined for Stardom. I'd imagine within 17 18 years we'll see him in movies, then rehab, then on a VH-1 celeb series Mr. Smith's Crazy World or some such nonsense. Don't kid yourself Viacom will be the mother and father from here on. He'll be dead by age 26 of an overdsose. Pretty morbid outlook, but I'm a morbid guy.

Not legally. The man who raises the kid and changes the diapers is the father, not the sperm donor.

In a shocking twist it has been discovered that the father of the baby is actually J. Howard Marshall II! "We froze some of his love stuff and I decided recently to make a baby. I kept Howards ashes on top of the TV and his love stuff in the freezer in the kitchen. I thawed it out and used a turkey baster!" Anna Nicole Smith was heard to say right before her death.

this is probably why howard stern took her there to have the baby.


at the time the baby was born I thought it was odd that anyone would go to the bahamas to give birth....now it makes a chilling kind of sense.
