BATFE Killing Idaho's Oldest Gun Shop

Red's Trading Post in Twin Falls, Idaho, is the state's oldest gun shop, opened since 1936. In 2004, a routine BATFE audit revealed minor clerical errors. According to Red's, out of nearly ten THOUSAND firearms transferred between 1996 and 2004, the alleged error rate did not even reach 1%. Even the BATFE acknowledges these are minor paperwork errors -- there are no missing firearms and no willful illegal acts.

And yet the BATFE has revoked the ability of Red's Trading Post to acquire firearms for resale, although they're still permitted to sell the firearms in stock ... for now. But that's not enough -- the BATFE wants to revoke Red's license permanently.

Red's appealed, was denied, and are now headed to federal court. They have spent over two years and $20,000 in legal fees in this battle and are now taking it public. The Red's Trading Post site even includes an article about a competitor -- Blue Lakes Sporting Goods -- who was similarly railroaded by the BATFE. In an act of supreme hubris, the BATFE actually denied the Blue Lakes the right to appeal until AFTER they were in the middle of a "Going Out of Business" sale!

Unfortunately, as our readers know, this is hardly unusual behavior for the BATFE.

During the March 28, 2006 Congressional BATFE hearings, attorney Richard Gardiner testified that the BATFE's "enforcement" tends to focus on trivial violations that do not affect public safety, and that the BATFE imposes an unreasonable standard of perfection on FFLs ( http://judiciary.house.gov/media/pdfs/gardiner032806a.pdf ). That latter is especially ironic considering the extremely poor state of the BATFE's own record-keeping, about which they routinely perjure themselves in court (see and hear it from the mouth of the NFA Branch chief himself at http://www.jpfo.org/rollcall.mp4 ).

This could be OK. What if every federal agency acted this way? You know, suppose the Department of Education went around firing all the teachers and closing any school where more than 1% of the students made mistakes on their papers?
Or better yet, closing any IRS service center where more than1% of the answers on their help line were found to be wrong.?

All I can say is this sort of thing wouldn’t be happening if, in 2000 after 8 years of Clinton, we had voted in a Republican as president.

It takes alot of time and work to get these bills passed in a clean manner. They usually aren't priority bills anyway.

It's the majority that sets the priorities, so if it wasn't a high priority, it's the fault of the party who had control of Congress from 1994 until 2006. After all, they sure had time to hold hearings about steroids in baseball.

They do. Try getting a job, or working on a job site w/o the proper training, or keeping records on said training. LOL! Big fines and jail time are in order.

Neither party is overly anxious to tackle gun issues. The Republicans were willing to do it , but like any other issue, it gets prioritized. Again I say , enjoy the Dims . If you hated the Republicans on the gun issue , you'll love what the Dims have in store for it ...

I doubt the Feds are more accurate with their accounting of weapon grade nuclear material.

If our pubbies prioritized gun issues lower than baseball steroids, then I would hardly say they were "willing" to tackle the issue -- at most they were willing to claim that they were willing.

And who said I was enjoying the donks? That's a strawman -- I haven't said one word in favor of them or their positions on RKBA. I can and will hold our elected officials to account for their actions or lack thereof. The only way elected republicans will change their ways is if we, their constituents, hold them accountable. It's people who deflect every valid criticism of republicans with a boilerplate "the dims are worse" that have encouraged our overconfident GOP congresscritters to be the pork-eating corruption monkeys that many have been over the past several years. If they had stuck to the principles that got them voted into congress in the first place, maybe we wouldn't be "enjoying" the donks as we speak.

Sure thing . The Republicans are being taught a lesson that we will all pay for .
We can debate about what the Repubs should have done , but as i've said before , i'll gladly take a bad Repub congress over a bad Dim congress . There is a difference , as we are starting to witness. It will only get worse .

Of course there's a difference. But I would rather have a good republican congress than a bad republican congress. And the only way I can think to achieve a good republican congress is to complain loudly when they're not acting as they should.

Too late now . It won't be easy getting the Congress back . It might be a long time . Most people don't understand the ramifications of losing the House . We will see it played out and there will be nothing we can do about it .

Too late now? I've been loudly complaining for several years -- only to be subject to criticism all over this forum that I and others who dared complain were traitors or liberals. It's not my fault that many republican candidates forgot who their bosses are and ignored what the people were telling them.

I agree it won't be easy to reclaim congress, and I was very unhappy about losing the house. I just place the blame with the republican candidates, rather than the republican voters. As long as we blame voters for refusing to buy a subpar product, the makers of that product (in this case, the republican party) are going to keep making it.

I understand that all political parties lose their principles if they're in power too long, but I am extremely disappointed that it only took the GOP a decade to forget why we put them there.

Yes, but it's done . The Dims are in , and in to stay . As i've said, i'll take the bad Repubs that didn't raise taxes and stopped all anti-gun legislation, over the Dims that are currently in control. The problem here , is that the anti-gun Dims control all but one committee (Dingell is a Lib, but pro-gun) . They can do as they please in the house, and God forbid they ever strong-arm the Bluedogs into going along with it .

I share your concerns. I do think there's a good chance that the donks will get overconfident and overreach. I hope there's a fair chance that the GOP will have rediscovered a cohesive belief system, a coherent message (and messenger) and the principles to back it up when that happens.
