The designation “Asian”, concocted by the government in order to classify people in violation of the Constitution, is overly broad. Asia is a huge continent. Lumping Russians, Chinese, Vietnamese, Korean, Indian, Japanese, Saudis and others together is a mistake.

You better chastise the British, as they lump citizens of middle eastern origin in there as well.

Just call him South Korean or South Korean national. I AAJA is saying that there’s no point in lumping him as “Asian” (which is a HUGE category) when we know more accurately what he is.

No, the issue is nationality since Cho isn't an American citizen, not race. If he were American, then the term "Asian-American" or "Asian" is perfectly acceptable (as they are racial categories used in the US). The point is that, if some Nigerian national did this, you wouldn't want to label him as an American black either.
