House Bill 4749 (MI helmet law)

Sec. 658c. (1) The helmet requirements under section 658(4) do not apply to a motorcycle operator if all of the following conditions are satisfied:

(a) He or she is 21 years of age or older.

(b) He or she has been licensed under this act to operate a motorcycle for not less than 2 years.

(c) He or she has successfully completed a motorcycle safety course under section 811a or 811b.

(d) He or she has in effect security in the amount of $20,000.00 for the payment of first-party medical benefits payable in the event that he or she is involved in a motorcycle accident as provided in section 3103 of the insurance code of 1956, 1956 PA 218, MCL 500.3103.

(e) He or she carries a valid permit obtained under subsection (3).

(2) The helmet requirements under section 658(4) do not apply to a passenger on a motorcycle if all of the following conditions are satisfied:

(a) The motorcycle operator has satisfied all of the requirements listed under subsection (1).

(b) The passenger is 21 years of age or older.

(c) He or she carries a valid permit obtained under subsection (3).

(3) A person shall obtain a permit under this subsection from the secretary of state before operating or riding upon a motorcycle on a public street or highway in this state without wearing a crash helmet upon his or her head. The secretary of state may issue a permit under this subsection if all of the following conditions are met:

(a) If the person is a motorcycle operator, he or she has satisfied all of the requirements under subsection (1) and pays 1 of the following fees:

(i) Annually pays a fee of $100.00 for a permit that is valid for a period of 1 year.

(ii) Pays a fee of $200.00 for a permit that is valid for 3 years.

(b) If the person is a passenger on a motorcycle, he or she has satisfied all of the requirements listed under subsection (2) and pays 1 of the following fees:

(i) Annually pays a fee of $100.00 for a permit that is valid for a period of 1 year.

(ii) Pays a fee of $200.00 for a permit that is valid for 3 years.

(4) A permit issued under subsection (3) shall contain all of the following:

(a) The person's name, address, and date of birth.

(b) The date when the permit expires.

(c) The following statement: "A person who operates or rides a motorcycle on a public street or highway in this state without wearing a crash helmet who fails to produce a valid permit issued under MCL 257.658c upon the request of a peace officer is in violation of MCL 257.658(4), a misdemeanor punishable by imprisonment for not more than 90 days or a fine of not more than $300.00, or both.".

(d) Any other information required by the secretary of state.

(5) Upon request, the secretary of state may issue a sticker to the registered owner of a motorcycle for application on the registration plate of the motorcycle if the registered owner of the motorcycle obtains a permit under subsection (3).

Ok, so i had to post the bill because i couldn't find any article that was postable here. Interesting that MI has vetoes helmet free laws for so many years, now this one will probablly pass because it generates revenue.

I think our helmet law still has all that other ‘stuff’ in it...but no one pays it much attention any more. I think we are supposed to get some sort of sticker from the Department of Public Safety if you want to ride without a helmet.

I see this as a reason for any cop to stop and question any helmetless rider - to check for the permit, of course.

Personally, I’ve made the choice not to ride sans helmet. Kansas does not require them. (My wife, though... ;-P)

It's all about freedom and fun until someone has to clean up the mess. Let the EMS people decide if they want to start carrying Hefty trash bags and shovels.

Can you believe the number of so called conservatives on this forum who believe in freedom, as long as it is freedom for them? A lot like liberals don’t you think? “I want to be free to do the things I want but bike riders must follow my rules and wear helmets, plus cigarette smokers and private property owners must bow down to the smoking police”. The helmet law and the seatbelt law were a giant step toward Nanny State. It always amazes me how many believe in capitalism and the rich should be allowed to keep their money yet a “person’s” choice should be regulated.

My only problem with this is that all motorists are required to pay for long term, no ceiling catastrophic care for underinsured accident victims. Eliminating helmets may insure that our rates all go up.

The provision I would add is that a helmetless rider is ineligible for the catastrophic care plan administered by the State of Michigan.

I agree with you and bikerman.

I wonder the percentage of freepers that sound off with dumbass “donorcycle” comments are against motorcycles and think they are dangerous simply because their wife will not let them own one.

No problem.

My decision regarding helmets is long-standing, but was reinforced by my accident (caused by turkey buzzards in Georgia) a couple of years ago. Three cracked ribs, multitudinous bruises, and a splitting headache from the helmet crashing against the ground convinced me I’d be better off with the helmet.

Besides, if I rode with my nads they might throw my balance off! ;-P

Fortunately I have had few minor accidents on the road. Couple broke bones.

Most major accidents were on a track where I was covered head to toe in armour under controlled invironment.

I say anyone who rides unprotected has not been down....

...yet.

What, no pork subsidies?

Unless and until Michigan legislature understands and embraces the importance of motorcycle accident prevention instead of motorcycle accident survival, the citizens of the Water, Winter Wonderland will continue to twist in the wind with absurd legislation such as this.

As an interesting aside, prior attempted repeals have made it through the state House and Senate, only to be vetoed by the socialist, myopic Governor Jennifer M. Granholm (who was born in Vancouver, British Columbia).

BINGO give that man a cigar. Only two types of people those who ride and those who wish they could ride. Both myself and the wife ride been doing it for years have over 150 thousand miles on mine alone I watch everyday the idiots in cages yakking on cell phones ,eating,reading,just have to shake my head and cry.

Most pitiful thing I ever saw......

I was sitting in a turn lane when a minivan pulls up beside me. Dude in the van is looking over at me and my chopper. I could see his wife’s mouth running ninety miles per hour but he wasn’t listening.
He looked up and down my bike and didn’t notice his light had turned green. His wife reached over and knocked him in the head and pointed at the light. He turned red with embarrassment and I could have sworn I saw a tear run down his cheek as he drove away.

Back when I was a kid, I guess we’ll call it the Ice Age what with all the global warming goin’ on, just about every kid had a trike and then a bicycle to ride.

Then, we were told of all the injuries, especially head injuries, caused by kids having too much fun on these dangerous toys. Did we hear from all these injured kids? Did we hear from all the parents of these kids? NO!

We heard from the nannies that there was this epidemic of crashes happening. So, every kid was REQUIRED to wear a helmet.

Not only has the number of kids riding bicycles decreased, but the fun of riding (pedaling) is gone. All thanks to people who want to protect us from ourselves.

I don’t know about you, but I’m gonna die. No three ways about it. If I die on my motorcycle, thank God I was doing what I love to do.

I have a Electra glide classic 2 tone blue peace officer bike I get the same look from male drivers also same pitiful stare usually their wife is in the car also.
