The fate of Ed Jew on the San Francisco Board of Supervisors may wind up being decided not by his colleagues or Mayor Gavin Newsom, but by state Attorney General Jerry Brown. Here's why:
Short of a voter recall, only the mayor or attorney general has the authority to set in motion Jew's possible removal from office. And the mayor can order a supervisor suspended only for "official misconduct."
Therein lies the problem.
City Hall insiders tell us that the bulk of the evidence gathered against Jew so far -- in the city attorney's civil investigation and the district attorney's criminal probe -- shows that his alleged misrepresentations about where he really lived came in the three-plus years before he was elected to the board last November.
If Jew really did register to vote on 28th Avenue while living in Burlingame, as San Francisco prosecutors charge, that might be illegal. But it wouldn't necessarily constitute "official misconduct'' because it occurred before Jew took office.
If Newsom tried to move against Jew on official-misconduct grounds, it would trigger an advisory opinion by the Ethics Commission and a final decision by the Board of Supervisors. There's an alternative, however, that might be more appealing.
City Attorney Dennis Herrera can sue Jew for failing to meet the residency requirement when the supervisor filed to run in District 4 -- but to do that, he needs to petition the attorney general for permission. We're told the city attorney is likely to do that this week.
Newsom hasn't ruled out simultaneously ordering Jew's suspension. But if he goes that route, it could be risky.
First, he would be bucking the advice of the city's own lawyers that such a case is legally shaky.

The Sunset district is populated by a large contingent of Chinese/American business owners and entrepreneurs. He is being singled out because he is as conservative as a politician can be and still get elected to office in SF.
Kamala Harris, the DA of SF, is an avowed Socialist. She is going after Ed Jew, in a large part, for the above reasons. Her actions are both despicable and predictable.
Post #2 was a duplicated by #3 and was asked to be removed.
Gesundheit!
I suppose the name is funny, but the more I hear about this the more I think he deserves our support.
Even if he misrepresented his residency, which this article now says is possibly not even true, that is so common and so trivial that it hardly is worth noticing. If it wasn’t objected to before the election it is hardly a crime worthy of prosecution now.
The DA, Kamala Harris, is a real scum. She’s not only a socialist, she’s a typical limousine liberal of the worst SF type, who worships left-wing money. Apparently Ed Jew helped her get elected, and this is the way she pays him back—because he’s a conservative.
They eat their own.
Interesting piece from a previous article..
San Francisco Supervisor Ed Jew and District Attorney Kamala Harris are certainly at odds now — she’s trying to throw him in prison, after all — but it wasn’t always that way.
In fact, the two have a relationship that goes back to 2003, when the Harris campaign paid Jew between $15,000 and $20,000 to help get out the Chinese American vote.
It apparently paid off big on election day. Harris not only carried the vote in Chinatown, but exit polls showed she won 48 percent of the Chinese American vote citywide. Neither of her two rivals got more than 29 percent.
But here’s the real capper. One of those two rivals was former prosecutor Bill Fazio — who is now defending Jew against the perjury and other charges brought by Harris
The FBI is also investigating charges that he solicited bribes.
I believe the FBI acted as agent provocateurs, coming up to him covertly and offering him bribes. Whether he was really entrapped or whether they are lying about it is a question, considering how corrupted the FBI has become in the past decade or two.
I wonder why they picked Ed Jew, and none of the other crooked politicians in California? They have a recent habit of investigating no one but Republicans and conservatives, evidently on instructions of the DNC & associates.
Joisey, too.
I am not 'defending' Ed Jew's actions as much as I am questioning why Kamala Harris is hell bent on going after him.
You may not be aware that she had a team of investigators poised and ready to go as soon as the FBI got a warrant. She was targeting him for investigation when there are other supervisors, in SF, who are also guilty of non-residence crimes, who have not been attacked by the DA.
I am not opposed to investigations, but I am opposed when city officials do not apply the law equally.
I am sure you are also opposed to that.
Exactly!
Why would a "conservative" help a "socialist...typical limousine liberal" get elected?
