As always in the liberal Beltway, no one's ever questioned Fitzgerald's unsupervised free ride and tenure as Special Prosecutor in the Plame/Libby case by his college summer roommate, James Comey, now legal counsel for the giant, Lockheed Martin.

IMO, Comey's ticked off at the Bush team and the WH, probably wanted to succeed Ashcroft, and poisoned the well of justice by giving his buddy a free prosecutorial ride. He knew Fitzgerald when they were law students and shared a summer house in Spring Lake, New Jersey.

Senate erases Libby pardon vote from record

"The body agreed to permanently remove from the constitutionally mandated Congressional Record a vote taken earlier in the evening on a measure that said the president should not pardon I. Lewis "Scooter" Libby, Vice President Dick Cheney's former chief of staff.

The Senate vote failed 47-49, but any reference to the vote itself was expunged as though it never happened.

A shame that we can’t find people who want to make a name for themselves preventing crime with cheaper and far more effective prevention programs than people like these who want to prosecute people like Conrad Black who committed no crime for the clear purpose of self-aggrandizement. All that did was send a message to many businesses to move operations out of the country. A real shame.

At 8:47 p.m., Sen. Salazar offered an amendment, #2356, a sense of the Senate that the President should not pardon Scooter Libby.

Speaking on the floor, he said: “It is regrettable…that we are having to have these votes on these politically motivated amendments that are coming forward from the other side. It would be in the best interests of this institution and the American people to stop this and not to go forward with these kinds of amendments. But regrettably, if you’re going to shoot this way, we’ve got to shoot that way. And so I would ask my colleagues to send the Sense of the Senate to the United States President that he should not pardon Scooter Libby.”

The Salazar amendment failed on a vote of 47-49

At 9:16 p.m., Sen. McConnell offered an amendment, #2357, “deploring the actions of former President William Jefferson Clinton regarding his granting of clemency to terrorists, to family members, donors and individuals represented by family members, to public officials of his own political party and to officials who violated laws protecting United States intelligence, and concluding that such actions by former President Clinton were inappropriate.”

And at 9:30, before any vote could be taken, Sen. Reid asked that the vote on the Salazar amendment be vitiated (first time I’ve seen that happen) and stricken from the Record, and further that we not vote on the McConnell amendment. Both sides agreed.

Statement of Special Counsel Patrick J. Fitzgerald regarding today’s decision by President Bush to commute the 30-month prison sentence of I. Lewis “Scooter” Libby:

“We fully recognize that the Constitution provides that commutation decisions are a matter of presidential prerogative and we do not comment on the exercise of that prerogative.

We comment only on the statement in which the President termed the sentence imposed by the judge as “excessive.” The sentence in this case was imposed pursuant to the laws governing sentencings which occur every day throughout this country.

In this case, an experienced federal judge considered extensive argument from the parties and then imposed a sentence consistent with the applicable laws.

It is fundamental to the rule of law that all citizens stand before the bar of justice as equals. That principle guided the judge during both the trial and the sentencing.

Although the President’s decision eliminates Mr. Libby’s sentence of imprisonment,

Mr. Libby remains convicted by a jury of serious felonies,

and we will continue to seek to preserve those convictions

I have no idea what he could do pre-emptively. It sounds to me like he is simply saying that he will fight Libby's appeal with everything he's got.

Exactly. This scumbag Comey has been a stealth Clintonite from the beginning. Kudos to the Bush Administration for ferreting the p.o.s. out and unloading him fairly quickly, but shame on them for hiring him in the first place. He's like a scab that falls off and keeps coming back.

I guess he could do what Ronnie Earle did to Tom DeLay...look around for more charges and do some Grand Jury and judge shopping. Then there could be a new trial, and he could get more time in the media limelight along with his buddy Comey, especially on NBC.

I'm sure there are Powell holdovers at State that would be happy to provide make up some info, this time something that would rope in Cheney.

anyone who has flagrantly and maliciously prosecuted, such as Fitzgerald did to Libby should have his license suspended. Fitzgerald is no better than Nifong - one in federal court, the other in State court. I hope we have enough Republicans remaining in the Senate after 08 that a Fitzgerald appointment can be blocked.

Comey is a Schumer pal and ‘RAT mole who never should have been allowed near the DOJ. He bears heavy responsibility for enabling the farcical Plamegate mess to go forward, when he should have had the judgment and guts to toss it all aside before he ever appointed FITZFONG.
