AKRON, Ohio (AP) - An Akron condo association is being sued over its policy barring babies and toddlers under three from the swimming pool.
The civil rights lawsuit brought by the mother of a 1-year-old and a fair housing group claims the Seven Stories East Condominiums is discriminating against young children because of fears they'll relieve themselves in the water.
The Fair Housing Advocates Association says a 4-year-old or even an elderly person could do the same.
The mother, Suzanne Malcom, says she was upset in mid-June when she was told to keep her son Lucas out of the pool. She says he was wearing a swim diaper and is potty trained.
A woman answering the phone at the condo association declined to comment.
Could it be more due to drowning/lawsuit fears?
If so, it’s ironic they’re getting sued for a policy that was probably intended to thwart lawsuits.
I wish all condo associations had such policies and enforced them.
I stopped using my association pool when I saw mothers dragging babies around in diapers.
A friend of mine refers to those little diapered tykes as teabags. The more you dip them in and out of the water, the darker the water becomes.
A one year old is already potty trained? Is the mom serious? Does the mom have other axes to grind with this lawsuit?
What’s the saying? I don’t swim in your toilet, so don’t pee in my pool?
I’m impressed that she managed to potty train a 1-year old boy - or so she claims

I highly doubt that a 1 year old is toilet trained.
It’s possible...One of my daughters potty trained herself right around her second birthday.
Potty trained at age 1!? I'm calling B.S.
And a swim diaper is only for the comfort of the wearer. Plastic overpants are necessary to prevent contamination of the pool.
She was a girl. Boys don’t potty train as easily.
geeeze... as a kid myself, in the ‘50’s, we use to go away each year to a little private utility unit place in the mountains and the little kids had to go to the kiddie pool till they were able to control themselves...ie were past the diaper stage.
It is more than possible to train a one year old. My daughter started training before her second Birthday and was ‘done’ b 26 months.
She still occasionally has an accident but she is doing fine
My next in line was born in November so we will start her at about 17 months and, Lord willing, have her done before two. (Best to train in the spring when little girls can run around the house in a dress and no diapers/training pants.
