Lefty Blogger Files FEC Complaint Against Fred Thompson

Here is the blogger’s (News From The Left) main argument and link:

By filing this complaint, posted below, the FEC can now proceed with action to right this injustice. According to FEC regulations, Thompson will have 15 days to respond to the complaint. Then, their lawyers will write an opinion on the basis of the complaint.

It is my contention that he has violated the ‘testing the waters’ exemption of election law. He has been presenting himself as a candidate for President, he has been raising large sums of money beyond what would be required to explore a possible candidacy, and he has signed a long term lease on a headquarters for his campaign. He has even spent advertising dollars, which are specifically prohibited by the law.

Well, you can’t argue with their facts. Whether they have a case or not is a sophisticated legal judgement beyond my ability to render.

the worst part (and glossed over) is the first apperance of this story came from a queer site called “queerty.com” (alerted by google) - it’s nasty... don’t go there...

As I posted in detail on the first thread on this subject, IMHO this Complaint is going nowhere. Based on my decades of experience before the FEC and in First Amendment cases in various courts, this Complaint will not survive the first hurdle, which is a "Reason to Believe" letter. This is an official finding by staff that there is reason to believe that the law has been violated.

Absent that finding, a Complaint dies without even going before the Federal Election Commission itself. With such a finding, the FEC is able to act. But since the Commission is equally divided between Repubs and Dems, and must act, if it acts at all, by majority vote, I think the FEC would trash this Complaint if it gets to them.

Whether you are pro-Fred, anti-Fred, or neutral about Fred, this case is going down the dumper.

No wonder Fred would not disclose he campaign manager. I you count rumors he had 3 at different times. My apology to anyone who I debated on the subject.

Nah, just because in "testing the waters" he doesn't have to keep to the donation limits or disclose to the FEC doesn't mean he hasn;t been doing it - How do you think everybody knows he raised a only a disappointing 3.46 million?

The money is good for campaigning.
