Sen. Kerry permits last statute of limitations for defamation to lapse ...

When I first brought it to his attention in September 2005, I reminded Sen. John F. Kerry that — based on the publication date on or about August 25, 2004, of Unfit for Command: Swift Boat Veterans Speak Out Against John Kerry by John E. O'Neill and Jerome R. Corsi — Sen. Kerry had already allowed the one-year statutes of limitations for defamation to expire in Texas (where Mr. O'Neill resides), New Jersey (where Dr. Corsi resides), and the District of Columbia (where their publisher Regnery Publishing, Inc. has its principal place of business and Sen. Kerry has his own regular place of business).

But as I noted then, Sen. Kerry's home state of Massachusetts has a very unusual, extremely generous and pro-plaintiff three-year limitations period for defamation claims. Massachusetts' three-year statute of limitations for defamation claims made it the very last feasible venue in which Sen. Kerry conceivably could file suit and gain his public vindication, if the SwiftVets' allegations about him were false. Those claims were certainly, indeed deliberately, injurious to his reputation; his damages arguably include the loss of the 2004 presidential election, however that might be valued in dollars and cents; and if John Kerry could hope to find a home-town advantage anywhere, surely it would be there. But now he's let the incredibly generous Massachusetts statute of limitations run out, too...

He’s a public figure. They’d have to prove reckless disregard of the facts, or actual malice (which does not mean you don’t like him). Fat chance!

Kerry lied when he said he would sign his SF180.
Kerry lied while chairman of the Senate, when he gave Communist Vietnam a “clean bill” for truthfully reporting the status of our MIA/POWs...

Kerry is a pathological liar, who has parlayed his lies into a position of trust within our government in the DEMOCRAT party...

Facts and the truth are a good defense against slander and libel claims. I’m sure that the last thing Kerry wanted to do would be to have the truth part of the public record!

Senator Kerry’s “Christmas in Cambodia” lie was undefendable.

The Swiftboat Vets busted him, and there’s no way that even a Massachusetts jury would rule in his favor on that point.

...plus, the Swiftboat Vets would have Discovery access to all of JFK’s trips such as his liaisons with NVA in Paris.

See.... here's the problem with the whole "defamation of character" construct the Democrats have tried to build around "Swiftboating".

It's really simple.

If it's true, it's not defamatory. Plain and simple.

Kerry didn't fight it, simply because he knew his personal history would never withstand the light of legal scrutiny.

All the wishful thinking of his misguided supporters will never change that.

The left is still fighting for the honor of ghengis carey. Notice that they only care about the 'integrity' of those that trash the troops and the mission, such as murtha and kerry, both with very questionable awards. I believe that murtha's Purple Hearts were awarded years after and kerry's awards were accumulated in the space of 1-3 mos. and none necessitated a day off or a stitch. Audie Murphy would have something to say about it, I think. Then again, he'd probably just spit in the dirt and walk away.
