[Pittsburgh] Homeowner shoots [armed] teen robber, ends up in jail

An unidentified teen is hospitalized today and the Washington County homeowner who allegedly shot him is in jail after an attempted robbery Saturday in Langeloth.

Police said two masked teens armed with BB guns and baseball bats were in the process of robbing the home of Eraldo Iannitelli shortly before 6 a.m. when he returned home. Grabbing a 12-gauge shotgun, he fired at the fleeing teens.

A 16-year-old boy was hit. Neighbors who heard his cries called 911. Police are searching for the second teen.

According to police, Mr. Iannitelli is being charged with attempted homicide, aggravated assault and reckless endangerment.

The 16 year old will be charged with robbery and aggravated assault, police said.

Dummy. If they are in fact fleeing, they pose no threat of grave bodily harm or death.

The teens were “in retreat” which in Pennsylvania means you are breaking the law by shooting them.

He made what I like to call the "Bernie Goetz Mistake" ie shooting someone in the back.

This is the reason, btw, that the French Connection was so controversial when it was released. In real life Doyle/Eagen could not legally get away with shooting even a perp in the back if they were not in the process of causing bodily harm to another.

Sadly, the laws in many jurisdictions state that even a robbed homeowner may not fire at a fleeing miscreant.

Of course, most of those criminals are never caught — unless they report to the ER with a load of birdshot in their asses.

If this does go to trial, hope the jury consists of former robbed homeowners.

You have to at least yell "They're coming right for us" to claim self defense.

That’s one of the first things they taught us during the NRA course on defense. You can’t shoot at someone who’s committed a property crime if they are fleeing.

If someone is in my house uninvited and armed, he's a threat, regardless of what he's doing or which direction he's heading.

Better judged by 12, and all that...

If the kids hadn't been running away, he probably wouldn't have been charged. Still, it seems unfair to charge him.
