Exactly right. His crimes are crimes against the state of Nevada. Hypothetical: if a man pulls a gun and robs a convenience store clerk, it is not dependent upon whether the clerk decides to “press charges.”

If it was a set-up why didn’t they video this event?

Also, Ron Goldman’s sister has now commented twice that this robbery had been in the planning for 3 weeks by OJ. Anyone else heard her say this. Each time she said it the media just let it drop and didn’t pick it back up. Seems like they just want the set-up and the audio tape to save him.

Just quessing but if he dies couldn’t he be charged with aiding in a crime that resulted in the death of the victim.

I predict they will get his testimony on video ASAP. Now if the state is smart (which they will not be) they will have the defense counsel present for cross in order to prevent any objection to admissability.

Nevada, like your home state of Florida, is "shall-issue" for concealed carry permits. It's very difficult to decide when to carry or not carry, and if carrying is not inconvenient, then some carry virtually all the time.

The presence of the firearms, in and of itself, may not have been a crime, assuming that the possessor was not a prohibited person.

But actually drawing the weapon, lacking a reasonable belief that one is threatened with great bodily harm or death, is quite likely a crime. Also, taking the weapon to the scene with the intention of using it makes the possession a crime, probably. Most permit laws likely only "permit" carrying for lawful purposes.

Nope...they can die decades later if it can be shown the death was the direct result of the commission of the crime. There's a recent case (past few weeks) of a cop in Philadelphia (?) who was shot during the commission of a robbery in the early '70s (IIRC). The perp was charged with agg. assault, and the cop was medically retired as a result of his wound. The cop recently died as a result of the wounds sustained during the hold up, and the perp, having long since served his time on the agg. assault is now in the dock for homocide....

I like to think of myself as a reasonable person. But I wouldn’t conclude that it was caused by the incident. If he’d had the heart attack during the commission of the crime I could think differently. I’m still scratching my head trying to figure out how someone can be aquitted of murder in a criminal trial, but found guilty in a wrongful death civil suit. Doesn’t this scare anyone else?
