Immigration Raids Single Out Hispanics, Lawsuit Says
NY Times ^ | September 21, 2007 | NINA BERNSTEIN

A federal lawsuit filed yesterday charges that agents of Immigration and Customs Enforcement unlawfully force their way into the homes of Hispanic families in the New York area without court warrants or other legal justification, sometimes pushing down doors in the middle of the night, in search of people who do not live there.

The lawsuit, filed in the United States District Court in Manhattan as a class action, accuses the immigration agency of conducting the raids in violation of the Fourth Amendment’s protection from unreasonable searches, harming citizens and legal residents of the United States as well as foreigners here illegally.

The 15 plaintiffs — all but one are residents of Suffolk County and seven of them are United States citizens — describe abusive predawn raids on their homes this year by armed immigration agents. They seek an order prohibiting I.C.E. from conducting home raids until the agency develops clear guidelines to end unlawful entries, and unspecified damages.

According to the complaint, the raids are part of a program called Operation Return to Sender that was started in 2006 to arrest and deport “fugitive aliens” or immigrants previously ordered to leave the country. But, the lawsuit contends, “the agents regularly raid homes where the fugitive is not present and could not reasonably have been believed to be present.”

The complaint contends that “the unstated goal of these raids is to gain access to constitutionally protected areas in hope of seizing as many undocumented persons as possible” to meet annual arrest quotas...

In the case of Ms. Aguilar’s family, immigration agents burst into their home in East Hampton to hunt for an illegal immigrant without a criminal record — Ms. Aguilar’s ex-husband, who had not lived in the house since 2003, when they divorced and he was ordered deported.

LOL!
Of course it does. That's who illegals are.
Next they'll be suing because the War On Terrorism single out muslims, and the War On Poverty singles out the poor.

1. Last known address...
2. If he was here illegaly, he is a criminal
3. If he was ordered to leave and didn't, he is a criminal
4. If he was ordered to leave and didn't, he may be a felon

They keep using the term "Hispanic" to mean "Illegal Alien". There is going to be a huge backlash over this. I'd personally like to see the author apologize. I think I'll go ahead and find them and write them and their editor. Perhaps their sponsors as well. Damned liberal idiots think all Hispanics are illegal? They can go to hell...

Not all Hispanics are illegal aliens but almost all (90-95%) illegal aliens are Hispanic.

WIKIPEDIA-

The largest per-capita source of immigrants to the United States comes from El Salvador, for which up to a third of the population lives outside the country, mostly in the United States.[5] According to the Santa Clara County Office of Human Relations.

The Pew Hispanic Center state that 57% of illegal aliens are of Mexican origin and about 24% are of non-Mexican Latin American origin. (BS In my opinion. Make that 90% of illegal aliens are Hispanic, not 81%)

Stop violating our laws, stay the hell out of here until you are legal and you won’t feel “picked on.”

US Citizens and residence should be secure in their homes. If ICE is entering homes without court warrants or other legal justification then the law suit has a valid point. The ethnic origin of the individuals is not material.

They’re claiming that there is no other legal justification. The ongoing commission of a crime, even if merely reasonably perceived, is a thoroughly legitimate legal justification. And harboring a fugitive is a crime.

Apparently, on at least one occasion, and probably a few, the police raided a home believing a fugitive was there, but the fugitive wasn’t home. The other occupants insist the ICE had no reason. Of course, to acknowledge the ICE had reason would be to confess to a felony.

I will say this: The ICE in Suffolk County is working their asses off to create as much bad press as they possibly can for immigration enforcement. While I was home last holidays, the local paper (a left-wing hate rag called “Newsday”) covered how the ICE were trying to deport a 30-year, middle-aged resident, who fathered several American citizens while married to an American citizen, in the middle of his chemotherapy. At the same time, the same area was making national headlines for the controversy over building illegal aliens shelters. The ICE had to drive past literally hundreds of illegal aliens to get to this old man...

So I wouldn’t doubt if this whole thing weren’t some deliberate action to provoke overly broad court rulings or legislation to cripple ICE enforcement.

“an illegal immigrant without a criminal record”

Illegal=Not obeying a law. Criminals do not obey laws. Hence an illegal is a criminal.
