Family of illegal alien gets $300,000 for his death

NEWTOWN, Conn. - The family of an illegal alien who was electrocuted while working at a town owned building in Newtown will be getting a $300,000 settlement.

The settlement will benefit the young daughters of Ivan Patricio Tenecela, an illegal immigrant from Ecuador who was killed in 2004 when electricity from a power line shot through an aluminum ladder and shocked him.

Maybe the town or state should go after the painting company for hiring illegal aliens?

I say hold employers responsible for whatever damages their illegal employees cause if they knowing hire illegals.

I’m tired of employers cutting corners to make themselves money at everyone else’s expense. Screw’em.

Actually, if the painting company or town did something negligent to cause this guy’s death? I don’t care if he’s illegal or not, hit ‘em for the money. If the guy’s family are illegals, send them back to Ecuador but give them the money, they deserve it. Then turn around and prosecute the painting company for hiring him in the first place.

If negligent employers have to pay the same awards for illegals that they do for “legals,” AND also have to deal with the hassle of prosecution for their hiring, it’s one more disincentive to hire them, and thus one more disincentive for them to come here. If the guy’s employer could get off without a penalty simply because he was illegal, then it’s the worst of both worlds—they can place their illegals in an unsafe environment and work them under conditions no legal worker would be allowed to tolerate, AND they don’t get prosecuted for hiring them.

...next time you mail off your premium,ask yourself, who's more pissed, them that got your money on what if's..or you when they say good thing RDTF sent in their premium

Exactly. Letting them off the hook just because the guy is illegal gives them one more reason to hire more illegals.

The taxpayers, of NEWTOWN, Conn., must love the illegal invaders....look at how the taxpayers treat them in this town. I guess everyone in America is wrong about the illegal invaders....Look at how this town loves the invaders....cannot America go ahead and surrender? Many lives would be saved!....../s

Had he been legally employed,he would have been under Workmen’s Comp rules (no recourse with employer) and wouldn’t have received jack-zip (like legal American employees)

...or, look at it this way. Back in the 30’s there were only 30 something insurance companies in the US. Today there are over 1000.
It’s a great money maker....they charge an amount depending on what they wanna make, or the specific state allows (campaign contributions has a lot to do with amounts).
They can change the rules on who they want to cover. If your an illegal from where ever...and you have a tendency to carry aluminum ladders around power lines, they can charge....hmmm..lets say $300,000 a year.

“knowingly”? I seriously doubt the company didn’t know he was illegal. But you know what - they have power lines in Ecuador. And you will get just as electrocuted down there from the same behavior as here...

Exactly, I’d go so far as to allow double damages against these companies.

The Problem with our immigration laws isn’t the lack of a border fence, nor or lack of enforcement, but the mendacity of business owners in hiring these people.

He probably couldn’t read all the legal warning labels on the ladder.... you know the ones all the lawyers have made them put on to make them moron proof so they don’t get their butts sued off.....(do not carry a ladder on a motorcycle, do not use a ladder as a teeter totter etc). Now the warning labels will probably need to be in many languages.

Being an illegal, he probably didn’t have insurance. The bill for his medical care, I am assuming he was sent to a hospital, should be taken out of the settlement. Someone else (taxpayers) paid for his medical care
