It was not his property and there is no mention of the bad guys being armed. Me thinks the shooter is headed for jail.
I think he’s bought himself some trouble. His wisest route would have been to confront them and hold them till cops arrive. Even that could potentially bring unlawful imprisonment charges. Hard to say.
His only mistake is he called the 911 first. He should have just plugged em and then called 911.
I’m grateful for these brave souls who are plowing ahead — and showing us how it is done — what to do and what not to to. Great that it gets covered at all, considering our libera media coverage.

Ouch... this may turn into a really difficult case.
I dunno what the law is in Texas, and I would love to have this guy for MY neighbor, but he may be in big trouble.
The argument he might make is that he had every right to stop a crime in progress against his neighbor. He ordered the perp(s) to stop. The perp made some threatening action (hopefully) and he then defended himself.
It doesn’t help his case that he started out telling the operator that he was going to shoot, and that was before he was personally threatened at all.
Dang. I’d give him the benefit of the doubt, but not all juries may do that.
If they were illegals, he’s done for.
If they were Americans, he’ll be fine.

An interesting possible twist from the message board at the local newspaper-—
“I live in the neighborhood where this happened, and there are a lot of rumors floating around today, mostly unsubstantiated, but I’m wondering if anybody else has heard some of this.
The rumor that’s spreading is that these two men who were killed do work for Centerpointe, and they were on duty in their Centerpointe vehicle. The person whose house they went into also works for Centerpointe, and was in the Harris County jail on some misdemeanor charges. He needed to get bailed out and these men were doing a requested favor by going to his house to get some cash he had hidden in a closet. That’s the reason why the neighbor was gone, and why we haven’t heard anything since about him. He’s in jail. Evidently this was not a burglary.
At least that’s what I’ve heard today, but I don’t know how much of it is true yet. I hope the dust settles quickly, because I’m really curious about the whole story.”
Impatient Texas man shoots burglars during 911 call
The ONLY unaddressed criminals in this incident, are the POLICE who couldn’t get police to the scene of a burglary in process in less than 7 minutes.
The report I heard, stated it was at least 7 minuted between the time of the call and the point at which the citizen shot the bastards to prevent their escape with stolen goods..
Lesson 1 — Don’t rely upon 911 or the Police to defend you or your property... Buy a gun and learn to use it...
Lesson 2 — Call 911 AFTER you have taken care of business..
No need to have an audio record of your decision to kill the bastards...
I interpret the “Move, you’re dead” as a fair warning to the perps to “HALT IN PLACE OR I”LL KILL YOUR SORRY ASSES”.
That warning was RECORDED on the 911 call.
In my book, that is fair warning, and it was ignored..
Refusal of that command, and any movement could reasonably be given as justification to protect himself from assault..
Nice thing about this shooting — HIS testimony will be the only version of the shooting......

It will be interesting to learn the ethnicity and legality of the perps....
According to Texas law (at least my layman's understanding of it), there's something about theft "under the cover of night", which is deemed especially cowardly and therefore deserving of being shot.
This might come into play and it might not.
I'm sure some Texas folks will weigh in.
Texas
