Gary Solis, a former Marine Corps attorney and a military law professor, said the service appears to be taking a very aggressive stance against Nelson.

“I know of no other case except Haditha where individuals have been charged with misconduct in the course of battle,” Solis said.

The case emerged when a former member of the Kilo Company squad from Camp Pendleton’s 3rd Battalion, 1st Marine Regiment, Ryan Weemer, allegedly told the Secret Service during a job interview several months ago that he was aware of an “unlawful death.”

He is being prosecuted in civilian court because he is no longer in the Marine Corps and was not subject to recall to service.

How does a civilian court claim enough jurisdiction to bring charges like this? He wasn't on a tropical island, lying on the beach, and committed a prosecutable act. How does the local judiciary claim jurisdiction over the military acting oversees?

Any first year law student knows, "no autopsy, no case." GWB needs to send the Haditha Marines home for the holidays...along with Compean & Ramos.

This case has been up before. Last time it came out that radio traffic and other evidence did a lot to refute the claims made by the whiner that started this crap.

Either something else got dredged up out of the abyss of invented evidence or someone’s just doing old fashioned witch hunting.

How does a civilian court have any jurisdiction over “crimes” that occur in foreign countries? Isn’t that like getting charged for speeding in a New York court for driving 75mph in Nevada?

This stinks of a witch hunt, to paraphrase your words. The precedent could immobilize our military if random judges (think ninth circuit) could grant themselves jurisdiction over all military personnel.

That law is a bit more severe than laws regarding citizen LEO’s. Police routinely shoot suspects in this country and it is all justified by the prosecutors...
