Unindicted Duke LAX players sue Duke University

DURHAM -- In a filing Tuesday in Federal Court, unindicted Duke Lacrosse players are suing Duke University, the City of Durham, Duke University professors, Mike Nifong and the DNA lab involved in the case.

The suit also names doctors and nurses who treated the alleged victim the night she claimed she'd been raped at a party. The players are also suing City Manager Patrick Baker and former Durham Police Chief Stephen Chalmers. As part of the investigation, the unindicted players had to give up DNA samples and were named in the school paper.

In the 404-page lawsuit, the players say that Duke University, the City of Durham and the other defendants were part of a "conspiracy to railroad 47 Duke University students" based on "the transparently false claim of rape, sexual offense, and kidnapping made by a clinically unreliable accuser." Also in the lawsuit, the players say that the accuser's claim was "taken virtually from her lips and fashioned into a weapon in the hands of those who would leverage outrage."

Not sure I'm on board with this part. Depose as witnesses maybe, but sue? Not unless maybe they falsified evidence or something.

you can if you can prove she perjured herself to the grand jury, the indicted DA and perhaps even a conspiracy charge w/the DA.

When the North Carolina Attorney General declared the three indicted players innocent and he said that there was never any evidence that a crime had occurred.

It appears that certain medical personnel at Duke hospital put out information early on that she had “signs, symptoms and injuries consistent with being raped and sexually assaulted” which allowed the false prosecution to proceed.

It would be pointless. She doesn't have anything they could get. She should've at least been charged with filing false reports with the police.

Yeah, I’d like to see her added to the suit. Can’t they get her for perjury for lying in a deposition? Surely she should do time for something, since she probably has no assets to speak of. As to Nifong, I hope he ends up totally broke.

I have followed this case closely. SANE Nurse Levicy is a feminist hack who publicly stated that she has never faced a woman who lies about rape. She also repeatedly changed the results (to be in line with Nifong’s new story line). She was essential enabler for the hoax. She also made the report even though only doctor had the right do it. She should probably lose her license for that alone. She is now working somewhere in NH.

I’ve been waiting for this one. Duke closed down the LaCrosse team and, as I recall, fired the coach. I wonder whether any of the players were at Duke on a LaCrosse scholarship and if so, what happened to their scholarship money.

They aren't suing the state; they are suing individuals. There is no sovereign immunity for individuals, even if they are acting on behalf of the state.

I’d like to see the gang of 88 fired and the whole ethnic studies program dropped. The whole idea of re-writing history as a meta-narrative, blaming white men for all the short comings of minorities and restorative justice is anathema to fair and equal treatment under the law. Duke should be the first university in the country to stand up and denounce this psuedo intellectualism.

Don’t you think that the fact that CGM was shown pictures of ONLY the Duke LAX team is grounds for a lawsuit? This strikes me as a sick “Russian Roulette” as it could have been any one of those players who were accused of rape. The three boys who were ultimately selected by CGM are now shown to be random victims of this monstrous lie. What a price they paid!

Any other lawyer here want to hazard a guess as to what their cause of action is re the medical people?

What negligence is alleged on the part of the docs and nurses?

So she had an inflamed vagina due to multiple sexual episodes with multiple men for a few days. That could reasonable look like rape.

She most definitely should be added to the lawsuit. She is just as evil as Nifong. There was no followup on the DNA actually found on her - apparently the lacrosse players were to be framed to cover-up those guys. A couple of talking heads have still been saying that the lacrosse players must have been guilty of something for what else would explain that this stripper/prostitute was not charged.

Not sure I'm on board with this part.

Medical personnel assumed that she was raped, even though she changed her story back and forth while she was in their care.

Their decision to take her word for it and provide her with medical records that bolstered her claims could well be negligent.
