Patrick eyes in-state tuition for illegal immigrant students

Governor Deval Patrick says he’s researching whether he can take unilateral action to allow illegal immigrants to pay in-state tuition at state colleges.

The governor made the comments while speaking to education and business leaders this morning.

Patrick, who has long supported the idea, says his legal team is looking into whether the change can be made without approval from the Legislature.

So that means he is willing to either give up federal aid or allow residents of any state to get the in-state tuition rate, right? That hasn't been removed as a federal law yet as far as I know.

The obvious antidote for this is for all students from surrounding states applying for admission to Mass. schools to just check off the little box for in-state tuition. Lather. Rinse. Repeat. And see what happens.

Deval is haunted by anxiety over the question "am I liberal enough?" and "what can I do to become REALLY liberal?"

Why the heck would Deval have to do this without the legislature? The Mass legislature is about 90% Democratic and they all helped elect this guy with the campaign slogan of “Yes We Can!” (which Obama was using the other night too). I’d think the Mass legislature would be delighted pass this for their buddy, Deval.

In September 1996, in the landmark Illegal Immigration Reform and Immigrant Responsibility Act (IIRIRA), Congress prohibited states from giving in-state tuition rates to illegal aliens. Members of Congress evidently never imagined that some states might simply disobey federal law.
It is a 1996 federal law that prohibits any state from offering in-state tuition rates to illegal aliens, unless the state also offers in-state tuition rates to all U.S. citizens.
