AN ACT TO PROHIBIT CERTAIN FOOD ESTABLISHMENTS FROM SERVING 1 FOOD TO ANY PERSON WHO IS OBESE, BASED ON CRITERIA PRESCRIBED BY 2 THE STATE DEPARTMENT OF HEALTH; TO DIRECT THE DEPARTMENT TO 3 PREPARE WRITTEN MATERIALS THAT DESCRIBE AND EXPLAIN THE CRITERIA 4 FOR DETERMINING WHETHER A PERSON IS OBESE AND TO PROVIDE THOSE 5 MATERIALS TO THE FOOD ESTABLISHMENTS; TO DIRECT THE DEPARTMENT TO 6 MONITOR THE FOOD ESTABLISHMENTS FOR COMPLIANCE WITH THE PROVISIONS 7 OF THIS ACT; AND FOR RELATED PURPOSES. 8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 9 SECTION 1. (1) The provisions of this section shall apply 10 to any food establishment that is required to obtain a permit from 11 the State Department of Health under Section 41-3-15(4)(f), that 12 operates primarily in an enclosed facility and that has five (5) 13 or more seats for customers. 14 (2) Any food establishment to which this section applies 15 shall not be allowed to serve food to any person who is obese, 16 based on criteria prescribed by the State Department of Health 17 after consultation with the Mississippi Council on Obesity 18 Prevention and Management established under Section 41-101-1 or 19 its successor. The State Department of Health shall prepare 20 written materials that describe and explain the criteria for 21 determining whether a person is obese, and shall provide those 22 materials to all food establishments to which this section 23 applies. A food establishment shall be entitled to rely on the 24 criteria for obesity in those written materials when determining 25 whether or not it is allowed to serve food to any person. 26 (3) The State Department of Health shall monitor the food

According to a new study, this Deep South state is the fattest in the nation. The Trust for America’s Health, a research group that focuses on disease prevention, says Mississippi is the first state where more than 30 percent of adults are considered obese.
Aside from making Mississippi the butt of late-night talk show jokes, the obesity epidemic has serious implications for public policy.

Note: “Epidemics” by definition are contagious diseases spread by an infectious agent, so what they are talking about is not an obesity epidemic. Although it sure pulls the emotional heartstrings.
What’s next, the state telling others thier too skinny and force them to eat?
Oh geeze not this again. This bill will NOT pass, and the sponsors know it. Mississippi has some of the most lenient smoking, gun, insurance, helmet, etc laws in the nation.
So when are they gonna stop giving food stamps to fat people?
