Update: Despite efforts from Fox News to facilitate this dying girl's wish to have her father at her bedise when she passes, the imovable, cold-hearted, beauraucratic, red tape of the Jucidiary, Bureau Of Prisons and U.S. Attorney are intransigent in their unwillingness to bend the "rules" to allow this to happen.

Yeah, I can’t believe the heartless remarks. This child is dying she doesn’t understand what’s going on with her daddy. I sure hope no one here has to rely on the decency of others in a heartbreaking situation like this.

So by your standard any convict who has a dying parent, a dying child, a dying relative, dog, cat, bird, etc, should be allowed to go home until they pass? He ALREADY had escorted vists to see his child.
Prison is not a hotel you can leave at your whim, no matter the reason. It's there as a punishment for a crime.
There are two morally superior camps at work here.
One is not better --- or worse --- than the other.
And I can make that statement without resorting to name-calling guilt-by-association.
Maybe we could let them out for children’s birthday parties, Christmas, school plays, etc. How can we possibly be so mean as to jail people for crimes when there are children to consider?
If he hadn't put himself in the situation of serving a prison term for drugs, he's be home with his daughter now.

TOO BAD, DAD. You've had your 2 - 3 visits, now rot in prison where you belong, you scum and when your daughter dies, just remember, its your fault you could not be there holding her in your arms.

Your right of course, and he damned well better spend EVERY single day of his sentence in prison, or justice will not have been served and society will have been cheated of its pound of flesh--even if a few days would be spent with his daughter and then added at the end of his sentence.
Oh wait, that would involve some measure of compassion and logic, which neither he NOR HIS DAUGHTER, are apparently entitled to.
For what it’s worth, here are some thoughts on this matter:
1. This little girl was diagnosed with cancer seven years ago, when the Dad was still free, and he made a choice to deal meth. Meth is a vile drug which now is responsible for a large proportion of the most horrendous child abuse and murder occurring now.
2. A conviction of selling meth doesn’t mean he wasn’t also manufacturing it. Many other charges are often plea-bargained in these cases.
3. The father has had several visits with the child. On the last visit, the media showed up, presumably alerted by the family because the prison officials were upset the media was there. Doubtless they feared a tug-of-war in front of the media with “heartless deputies” versus emotional family members.
4. The child is no longer aware of her environment. Articles say she is now unresponsive and the best the family spokesperson can say is he thought she breathed easier when her Dad was there with her. On the other hand, we do not have any idea how long she will continue to hold out. It could be tomorrow. It could be months from now.
5. The child is in a hospice. There are other people there, also dying, also wanting last wishes such as peace and quiet for themselves and their families and not a media circus caused primarily by the family.
6. It may indeed appear heartless but I doubt we have the entire story. It appears the family has been demanding either a pardon or clemency, or a transfer to a work-release program where Jason could live at home until just recently. The request to allow him there just as she dies is perhaps a later innovation to increase pressure on the prison officials.
7. It is a rule of law that tough cases make bad law, meaning if we rule on emotions only we usually screw up royally because it sets a bad precedent. I sympathize with those urging people to concentrate solely on the child but I also know the law has to concentrate on the offender and the rules. If he does not qualify for the extraordinary rule on releases or transfers, there just might be a reason why, at least more than some official’s power trip considering the bad press it is garnering.
This is a sad case but I don’t think it is as black and white as any of us think it is. Were we wise as Solomon, perhaps we would have a solution. As it is, we are all reacting based on the media’s template. Why should we trust the media more on this than any other case?

I’m sure though that a lot of his customers had kids who were begging mommy or daddy not to buy any more drugs. I bet he didn’t spend a lot of time thinking about their families and the hell his little business was unleashing on those babies.
But of course, those kids are just the children of derelict drug users right?

he was scheduled to be released in August. Prisons are overcrowded. Many thousands are there for stupid reasons. Non-violent laws are stupid — sentencing does not matter the crime, and does not prepare the incarcerated for life outside (75% of inmates are released to the public and need HELP with adjusting on the outside but never get any help or compassion). Apparently he wasn’t in for a violent crime — only drug use.
Not everyone who goes to jail or prison is evil or is a monster. Many make stupid or selfish mistakes — many more have addiction issues which alter their ability to be responsible citizens. I’m making no excuses, but this is the real world we live in, and all of us belong to the human race, where there should be grace extended to those in need — not just to those who have perfect credit, never get a speeding ticket, or who never are arrested or break the law.
This father should have be RELEASED — not simply given a “pass” where he was escorted to the hosptial by prison staff and then is going to be sent back. That’s ridiculous.
In reply to post 36, you are not alone. I’m ashamed that fellow Freepers would be so willing to deny a dying child her wish to be with her father when she passes. All they have to do is assign a guard and let her father help ease her fear. It’s not for him, it’s for her. SHE asked for him, not him asking to be there. But by all means, let’s deny a little girl her wish to have her father there when she dies. Just because her father might be a turd, don’t take it out on her. That is a very liberal mentality. “Let’s ban guns to all people because one person did a bad thing.”
There are some real heartless b**tards on this forum sometimes.
I’m sending email to everyone I can to get this girl her dying wish. I hope that others do the same.

Never expect the government to have compassion. Expect them to take your money and manipulate its distribution to seek more power.
You may be right that I and others, are acting on instinct, emotion and a degree of compassion--although for 64 years, my instincts have served me well (and even saved my life a couple of time when in Nam), but what to hey, the RULE of LAW is what it is and never shall it be abridged or conditioned.
Well, I think I will go and have a nice double shot of VO, take a hot shower, say a prayer for father, daughter and all of you hope to God none of you or I are ever subjected to such a miserable situation whence there are no winners-- only the righteous and above reproach!!
