WASHINGTON (AFP) - The Pentagon has dropped charges against Mohammed al-Qahtani, the alleged "20th hijacker" in the September 11 attacks on the United States, a Pentagon spokesman said Tuesday.
Susan Crawford, the convening authority for war crimes trials by special military commissions, gave no explanation in dropping the charges against al-Qahtani "without prejudice," said Commander Jeffrey Gordon.
"They have been dismissed without prejudice, which means they can be reinstituted at any time," he said of the charges.

Further evidence that treating terrorists like criminals with legal rights is absurd. Expand Gitmo...don’t close it down.
We’ve been treating terrorists as criminals for over 20 years.
When “terrorists” are seized on the battlefield and brought to Gitmo, they are enemy combatants. They are prisoners of war, not “criminals”.
It sounds like a plea bargain upon which neither party wants to comment.
They should be treated as terrorists ...not enemy combatants or prisoners of war. They reject the Geneva convention, do not wear uniforms, behead our soldiers, etc.
The way we coddle them is taken as weakness instead of appreciated.
Better to taken none prisoner (kill them in combat) than send the wrong message that encourages jihad.
Mohammed al-Qahtani was one of six men charged by the military in February with murder and war crimes for their alleged roles in the 2001 attacks. Authorities say al-Qahtani missed out on taking part in the attacks because he was denied entry to the U.S. by an immigration agent.
But in reviewing the case, the convening authority for military commissions, Susan Crawford, decided to dismiss the charges against al-Qahtani and proceed with the arraignment for the other five, said Army Lt. Col. Bryan Broyles, the Saudi's military lawyer.
Crawford dismissed the charges Friday without prejudice, meaning they can be filed again later, but the defense only learned about it Monday, Broyles told The Associated Press.
The attorney said he could not comment on the reasons for the dismissal until discussing the case with lawyers for the other five defendants. Officials previously said al-Qahtani had been subjected to a harsh interrogation authorized by former Defense Secretary Donald H. Rumsfeld.
