Yes, but no one here is asserting that rights come from the state. Just that the idea that if you want to do something you have a right to do is has no historical basis whatsoever and the Founders would have been shocked by such a notion.

Our nation was founded on the notion that rights did not need historical precedent. Had the Founders believed as you suggest, they could never have broken away from the crown.
They did believe that you had a right to live your life in any way you pleased, with very specific exceptions that could be regulated by the state. Those exceptions are listed in the Constitution, and the evidence that anything at all not regulated therein is a right you and I enjoy is found in the clear language of the Ninth Amendment.
I appreciate your willingness to discuss things honorably. I don’t think we’re all that far apart. I just don’t think the 9th Amendment is as wide open as you perhaps do. It appears to largely be a rule of construction for the federal courts, to keep them from injecting themselves into areas where the Constitution was silent. It wasn’t intended to mean, for example, that there exists a right to commit sodomy which could be enforced by the courts in defiance of state legislation.
The problem with allowing the courts to weigh in on such subjects is that the judges simply pick and choose which unenumerated rights they wish to protect, based on their own personal preferences.
For example, did women have a right to vote under the 9th Amendment? It would seem silly to assert that they did, given the fact that the authors of the 9th didn’t even consider the issue worthy of debate, and the states which ratified it all excluded women from the vote. Yet, under your reading of the amendment, what was to stop judges from announcing that women had a natural right to vote that was inherent simply by virtue of women’s existence? What was to stop judges from mowing down the election laws of every state in the union and enfranchising women by judicial fiat?
