I appreciate your willingness to discuss things honorably. I dont think were all that far apart. I just dont think the 9th Amendment is as wide open as you perhaps do. It appears to largely be a rule of construction for the federal courts, to keep them from injecting themselves into areas where the Constitution was silent.

But I cannot agree. I am simply unwilling to ignore the plain language of the Amendment based on what it "appears" to be. The Amendment couldn't be more plain.
If you want to look beyond the plain language towards intent, think about the fact that many Founders opposed the idea of a Bill of Rights for the very reason that some people would mistake the Constitution for a list of rights.
The Founders were indeed wise, as that has actually happened. Sadly, even conservatives make this very fundamental mistake.
