Woman Sues Airline for Serving Peanuts

A Long Island woman has filed a lawsuit against American Airlines claiming the carrier endangered her 4-year-old son by serving peanuts on her flight, Newsday reported.

Tehmina Haque says she was assured several times that peanuts would not be served, but flight attendants changed the plan without notice during her April 18 flight to Los Angeles.

Her lawsuit claims she was “tense and fearful .. that her son would have an anaphylactic reaction while imprisoned 35,000 feet in the air,” according to Newsday.

An American Airlines spokesman would not comment on the lawsuit.

The carrier’s peanut allergy policy reads:

“American recognizes that some passengers are allergic to peanuts. Although we do not serve peanuts, we do serve other nut products and there may be trace elements of unspecified peanut ingredients, including peanut oils, in meal and snacks. We make no provisions to be peanut-free.

"Additionally, other customers may bring peanuts on board. Therefore, we cannot guarantee customers will not be exposed to peanuts during flight and strongly encourage customers to take all necessary medical precautions to prepare for the possibility of exposure.”

I had a MIL like this..... spastic about everything. It was basically a way of attracting attention to herself. In her later years (and many “dramas” later) I took her to a shrink. She was diagnosed as bipolar and put on Luvox. After a couple days of medication...... we had our first “lucid” conversation in 30 years. What a waste of her life....... and unnecessary frustration for those around her.

I wonder if she takes the kid to the grocery store? Lot’s of peanuts there, sometimes in open bins. oh, my.

This is RIDICULOUS! When I was growing up I had friends who were allergic to various things - their PARENTS made sure EVERYONE knew about it. They didn’t leave it to chance.

A few years ago, a young teen died after eating a snack at a local water park that had been cooked in peanut oil. Did his parents sue? NO!!! They rightly said, that he was at an age where he had to ask the questions himself, that they wouldn’t be ABLE to guard him against these things all of his life. While very sad, and the vendor, very sorry, they didn’t turn around and SUE the water park, nor the vendor. They amazingly agreed with all of those who said - it’s unfortunate, but he knew the risks. HE knew better...

Actually, breathing in the peanut dust could cause a serious reaction. I know people who can’t even go into a restaurant that peanuts are served or food is cooked NEAR peanut oil.

And given his circumstance of being in the air, I would worry too.

Kids have died from exposures to traces of peanuts.

Dennis Prager was talking about this on his program last week. He said that he was unable to find even one instance of an actual event where a person died from eating a peanut, much less "eau de peanut." He claims that this is an "urban legend" and challenges anyone to provide a real instance of sudden peanut death, date, time, place and name of person involved.

FYI-I looked up Ms Haque and it turns out she is a Dr. of Ophthalmology. I was just wondering about the name, it sounded like she might be of a certain faith. Ok, flame away those who wish it. She speaks French and Urdu. Might she be from Pakistan? Being a Dr she would have known about all the complications and would be carrying an EpiPen. Now maybe this wouldn't do the trick for her son but, if that's the case, she shouldn't be taking him anywhere. I'm just curious about ulterior motives when I read that she is a Dr. from (likely) Pakistan and goes on a flight where any number of people could have peanuts in their possession. I'm just saying.

Yep - she better hope that the judge does her a service and sustains the demurrer American will undoubtedly file. No harm - no cause of action. I’ve no doubt she was scared, I probably would have been, too, but unless you suffered actual harm, you have no cause of action. You can collect “emotional distress” damages only adjunct to an actual tort; they cannot be the tort itself.

I know of at least one American’s law firm - they don’t come cheap.

Huh. . .I thought airlines stopped serving peanuts sometime back because of the allergy issue. Guess I was wrong.

The woman asked and was told that peanuts would not be served. What else do you think she could have done? Her only other choice is never to allow her child on an airplane just in case the flight attendants serve peanuts. Is that what you think she should do?

Pray tell, do You happen to be her attorney on this quack case? AA should put her son and the Idiot (mother) on a NoFly list. She is obviously mentally unbalanced and her lawyer is as well.

Yep pretty much. I’m fed up with all the “accomodations” normal people have to make for those that aren’t. Can’t help it if the kid is allergic as the mother claims. Hope the judge asks for definite proof of the allergy.

#1. The airline CANNOT screen every passenger to insure that they do not have trace amounts of peanut or other tree nuts on them. Therefore, they cannot acquiesce and accept this responsibility.

#2. This mother should not be going anywhere without an epipen.
