1) It isn’t discrimination if the student already speaks English as either a first or second language.
2) It isn’t racism as language and race are not linked.

Not that I side with the plaintiffs in this case, but this defense, the “people might be talking about other students behind their backs” defense is really very stupid. How about just English is the language of life and commerce in this country. In order for the students to be successful in their lives they must speak English and we will only speak English in this school so that they have lots of practice toward total proficiency.

I can understand their concern. Where I work we have a diverse work group and a few years back we had some folks from Africa who spoke French and Swahili, and their group leader on the production line was Vietnamese. He swore that when they started talking amongst themselves they were conspiring to slow the line down.
What was funny about the whole deal is when he got with his buddies they all spoke Vietnamese which he had no problem with.

In this day and age you do not know what folks are talking about if they don't speak English and that can be trouble in certain circumstances.

This is Win-Win.

Catholic school is a private operation and they can set their rules. No one has to go to one. No one is forced to pay tuition. Don't like the rules? There's the door. First amendment rules don't apply -- ask anyone that tries to run a "free" newspaper.

OR the courts could rule against the Catholic school, admitting that in some way it is a public accommodation. If that's the case, every other parent in the school should sue for voucher money so that their child can afford to attend a public accommodation.

Private schools are ALLOWED to do such things. This is a lawsuit to nowhere.

Three families are suing alleging that the policy discriminates against those who speak other languages and lawyers for the families say it's racial discrimination and therefore violates their civil rights.

Witchta, Catholic schools are **FREE**. Every Catholic child in the these schools can attend FREE! The members pull this off through tithing.

I bet these families are merely in the school as operatives of the NEA and Democrats in an effort to bankrupt this **marvelous** free program for Catholic youth.

If this idea of FREE schools for Christian youth were to catch on throughout the country...Well!...We **know** what would happen to government teaching jobs and votes for the Democratic Party.

My grandmother wouldn't speak her native language in front of Americans for that reason, that they would know that she was not mean mouthing them.

In 1959 there were 3 Hispanics in my school, Junior, my best friend, and his sisters Gracy and Cookie. Their dad was an engineer at RCA.

2008 in the same neighborhood I have a 5 year old that starts school this September. There are 22 white kids and 425 Mexicans. The school has an API score of 779 and an API year over year growth of -4.

I think it is time to give California more money for schools for protecting us from peasant immigrants.
