California Voters Approve Constitutional Ban On Same Sex Marriage (Prop. 8 Passes Alert)

After an intense campaign that cost more than $75 million, California's voters have approved a constitutional ban on same-sex marriage, dealing a huge blow to the gay rights movement and setting the stage for another round of court battles over the volatile issue.

While the Yes on 8 campaign claimed victory just before midnight, the numbers continued to play out in their favor this morning. Still, advocates of same-sex marriage had clung to hopes that a surge of support from uncounted votes could still overcome the ban.

But this morning, with 95 percent of precincts reporting, the measure passed with 52 percent in favor, and 47.9 percent opposed. There are an untold number of absentee and provisional ballots

Left to be counted, according to the Associated Press, but it will be hard to overcome the 5 percent margin. The San Francisco City Attorney's office says he plans to file the legal challenge in the California Supreme Court to challenge the validity of the measure. Also, the first lesbian couple to be married in Los Angeles County after the Supreme Court threw out the gay marriage ban plans to announce a lawsuit arguing that the proposition is unconstitutional.

Obviously the Constitution is unconstitutional!?!?.....or so the judges will say as they over rule the will of the people once again.

Wasn’t there a parental notification law on the ballot in CA as well that was defeated?

Such a ballot proposition passed by a larger margin in Massachusetts, but the Massachusetts Constitution is harder to amend, and the legislature basically gave it a pocket veto by unconstituionally refusing to enact or vote to repeal the ballot question.

Oh Pleeeeze...we just elected the most radical abortionist in our history....this issues “pales” by comparrison....AND, it will be over-turned by Obama appointed judges.

Today...I believe that the majority of America is non-religious/selfish/and just plain stupid. Traditional values are for the minority goup...and that would be US!

They can't overrule a constitutional amendment. Obviously you can make something that's previously unconstitutional valid. The California Supreme Court would have to turn down the legal challenge.

See, I think this is very interesting. Similar propositions passed in Florida and Arizona. That tells us that most people have the same values as McCain, yet they voted for Obama. That is what the Republican party needs to build on. They need to focus on the fact that the vast majority of Americans share their values and somehow convince them to support everything else. How is anyone’s question. It should be the main goal for 2010 and 2012.

I did not think for a second that a constitutional amendment would be the end of this. The same people who grounded themselves in the California constitution as interpreted by the courts to agree with them will now be saying the California constitution doesn’t matter.

I’m sick of having to say over and over that this proposition BANS nothing. It AFFIRMS the pre-existing law that was unconstitutionally overturned by the judges of the California supreme court. The chief victims of those lawless judges will be the disappointed gays who will now see their phony “marriages” invalidated.

In your state, they passed it. The Left's problem is that while they can get people to vote themselves freebies, its harder for them to get them to change the way they live their lives. Most Americans believe in God so moral relativism has a hard sell in this country. If same sex marriage, were popular, they'd put a measure on the ballot to make it legal. In no state, Blue or Red, have the proponents of same sex marriage ever tried to make a case for it to the people. They've had to get judges to impose that for them.

Exactly.. I worked hard for the prop 8, but the judges will strike it down...It conflicts with the clear wording of the constitution re: gay marriage. They really don’t need to find the wording anymore they can just say it is there.

Yes, there is the typical “what’s in it for me?” angle. I don’t think Republicans should win that battle, but perhaps they can appeal to hard-working Americans who resent such attitudes. And they will resent it very soon. BTW, I’m so excited about the wealth that’s going to be redistributed to me starting January 21st.
