Obama and Biden bode well for Constitution

President-elect Barack Obama and Vice President-elect Joe Biden are supposedly very different pieces of the Democratic puzzle. Obama is the relative newcomer to Washington, the change agent. Biden is the senior "man of Washington," the old hand who can make change a reality. But Obama and Biden have one thing in common: They've both done stints as constitutional law professors. Obama taught at the University of Chicago Law School -- along with brilliant former jurist and liberal Congressman Abner Mikva -- while Biden has for many years taught at Widener Law School in Delaware.

This unique pairing intrigues New York Congressman Jerry Nadler. "(Isn't this) a change?" muses Nadler, who chairs the Constitution subcommittee of the House Judiciary Committee. "After eight years of trashing the Constitution, we have an administration that actually respects the document."

Wisconsin Democrat Tammy Baldwin, a House Judiciary Committee member, says that "if we are not able to hold the current administration to account, then when this administration hands over its responsibilities and authorities to a President Obama and to a Vice President Biden, they will responsibly choose not to exercise some of the powers that we would argue were overreaches by this administration. I would hope, also, that they would choose to help us to renounce the activities -- torture and rendition, spying on American citizens without a warrant, outing CIA agents, whatever it is -- that have been identified as abuses. Given their grounding in constitutional law, they should be inclined to do that."

So maybe when a new president and vice president swear oaths to defend the Constitution, they might actually mean it?

"Exactly," says Baldwin.

His Constitutional Law Class was a joke by all accounts from the students.

Some years ago, not being a lawyer myself and trying to flatter the child of a friend who just completed first year law, I asked a Constitutional question regarding the 2nd Amendment. Not something arcane which would require extensive knowledge. He was clueless, and seeing I was puzzled, he explained that the Constitution is taught in the second year. First year being designed to weed people out, and teach advocacy skills. What to advocate can wait. Two sides to everything after all.

I don't usually do barf alerts, but yes.

Capital Times is usually enough, but throw in Biden, Omama, Professor and Tammy Baldwin, it's obvious.

Remember, these people will soon be running our nation.

That’s what is concerning me now ... he’s not yet in office and look what’s happening to the economy just by what he’s been saying, then too, look at the run on guns and ammo ... I went with my dad to Walmart to buy some more and they were pretty low. We asked about shipments and they said it was slow .... one person was buying ammo just because ... he didn’t own any kind of gun ...

And Barack Obama is such an expert on the Constitution that he can clearly see where the founding fathers were WRONG in not including judicial activism, social justice, and economic justice in our courts.

That requires an amazing level of arrogance, doesn't it. Most living Constitution advocates argue that the Founder built a living document. Not that they were a bunch of uncaring folk who simply missed the key issues, not to be added by executive order of The One.

To all those who want the barf alert, I got sick just from reading the title! Besides, it’s good practice for the next 4 years. We have to get as good as the Russians at deciphering the media, especially when we loose our freedom of speech here and on the radio.

No, though I’ve forgotten the question, it wasn’t a simple one. Related to the arguement leading up to the final wording, individual vs collective right issues, if I recall. I was struck by his statement that it’s not tought till year two more than his lack of an answer.

yes and they get it straight too, you know that the Constitution is a living document that can be molded and contorted for the good of the people. They will continue in FDR's footprints, you know how he wanted to make a new bill of rights that will feed, clothe and medicate the masses. Yes it will be a thing to behold....(giga-sarc)

Tammy is humming the Party line.

Law school does not teach what the Constitution provides or means. It teaches what the Supremes over the years has said it means. Some of the arguments and decisions of the Supremes have been flatly improper. See for instance, “The Politically Incorrect Guide to the Constitution.” by Kevin R. C. Gutzman, J.D., Ph.D. ($13-14).

Worse, Biden believes the Constitution is a living, breathing document that is not to be limited to the obvious intent of those that drafted and ratified it. As Chairman of the Judiciary Committee, Biden was a significant reason Judge Bork was “Borked”. Bork believes judicial authority ought to be limited in a representative government, a thought that frightens Biden and his ilk. Of course, we more and more have a Supreme Court that increasingly acts as a Supreme Legislature.

Our nation is going down the crapper and discourse is dying. There is a black owned radio station here that has been historically black owned for 50+ years.

And the weekday morning host has gotten flack in the past for defending Bush and Governor Rick Perry on some matters.

But with barack, he’s even gotten into disputes with other radio personalities (also black) on this station. This host sees helping the poor and black communities (not necessarily the same thing) as being more Christian than opposing Barack’s positions on abortion and homosexuality.

That said, this host is also a defender of gun rights. He has talked about his gun on his show numerous times and says he has it to protect his things. With lethal force if necessary.

So today I tune in and he’s talking with a caller and they are talking about the scared white people buying guns and making the whole issue seem like white people are afraid that black Americans are now going to go wild and theiving etc. FALSE. Racist. Blatantly FALSE. The people who are buying guns are trying to beat the timer before any new legislation can be passed to put more obstacles in their WAY of buying a gun or keeping the government from keeping a list of just who has how many guns.

And if the host is so defensive of any concern about the black community being involved in the crime of home invasion, just why is it HE has a gun? Doesn’t he trust those around him?

Bigot. Naked bigot and race baiter. He may not actually believe all the trash he’s been spouting since this election started (and for the record I don’t believe that Pastor Wright believes white people made AIDs, but he knows that some of his flock do and it works as a hot button issue) but what he’s saying does NOT bring the community of Harris County together by sowing the seeds of racism.

Neither were Professors, as in tenured Professors, but that's no reason not to say they were.

Did either ever even work as a lawyer?

I know Biden grew asthma to get out of going to Vietnam when he graduated law school and just a few short years later was in the Senate.
