From my reading of the “Show of Cause,” LisaL did not file a motion, she filed an affidavit. The plaintiff was ordered to file an opposition to the defendant’s motion to dismiss. What they filed instead was an affidavit.

Any lawyer (or paralegal for that matter) knows that when a motion - any motion - is filed s/he has X days to file an opposition or the motion is granted. It is rare that an order to file an opposition would be issued, which would indicate that the plaintiff was given an extraordinary opportunity to file his opposition. That was not done, yet the plaintiff was given additional time in the Show of Cause to file his legal points and authorities in opposition to the motion to disiss.

In this case, a motion to dismiss that is unopposed is granted. End of story. This is not rocket science. Frankly, it looks like legal malpractice.

Let’s see if SCOTUS runs and hides again. They failed to live up to their oaths by ignoring the prior cases. I pray they will wise up very soon and honor their oath to defend the Constitution.

It means that the plaintiff met the court’s requirement by showing cause .. which apparently had to do with the court’s uploading the document that was filed on time. So the case continues.

Maybe you missed the opening: “from my reading of the Show of Cause” which has since been shown to have resulted from a technical glitch, and, fortunately, an appropriate opposition was, in fact, filed timely, leading to the discharge of the Show of Cause.

However, had the facts been as set out in the Show of Cause (and that is exactly why a Show of Cause is issued), the lawyers would have royally screwed up. The judicial system has a way of correcting itself.

. it appears to me that an officers duty is to defend the Constitution first and foremost. If I am wrong someone please point out where I went wrong.

Seems like Goetiner has a better background than BO.

The problem is he just wants to persue federal employment and BO was “appointed” as the messiah. BO feels he doesn’t have to prove anything...at least that’s what his worshippers tell us.

Apparently it is rocket science; since some things have been removed from the right side since yesterday regarding other things from this case so who knows the truth. I do agree about the affidavit.

The ‘rocket science’ I referred to was meeting a deadline. Missing a deadline is what keeps lawyers awake at night. You don’t miss a deadline, period.

Interestingly, it seems the attorneys’ computer system is too advanced for the court to properly upload, so all the judge saw clear was the affidavit, and the rest uploaded as junk. I don’t know what ‘some things have been removed from the right side...” means.

While everyone heaps on the courts, judges, etc., the judicial system is set up beautifully in that a Show of Cause afforded the attorneys the opportunity to set the record straight. So now this case can move forward on its merits.

I’d like to believe that if a regular person can get news over something like this, well surely the obamaBC issue is just as important too. I don’t under stand this veil of protection.. Until we get some kind of offical report, I will never gitit.

Oh, it’s important. However, the media feels we don’t have the right to know anything about it. They report, they decide.

Until something really horrible happens that turns them against him, they’ll suppress the story...and even then I’ll have doubts that they’ll speak the truth.
